That an application for non-conforming use permit, <br />NC-56 was filed with the City of New Brighton on <br />October 6, 1982. <br /> <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a pUblic hearing on <br />October 19, ~982, all person's present at the hearing <br />were given an opportunity to be heard. <br /> <br />That such application was reviewed by the City Council <br />on October 26, 1982, <br /> <br />The written comments and analysis of the city staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />;i <br />'1 3 <br />it . <br />;, <br />f: 4 . <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton city <br />Council makes the following Findings of Fact in respect to <br />NC-56: <br /> <br />1. That the property is zoned R-l, Single Family <br />Residential; <br /> <br />2. That the existing house has the following type IV <br />non-conformities: <br /> <br />A. Lack of required 30' front yard setback - the <br />bedroom side of house has a 25 foot setback; <br />and <br /> <br />B. Lack of required side yard setback - the north <br />side yard is only 4.4 feet. <br /> <br />3. That the garage addition will meet the 30 foot setback <br />and not encoach on the side yard setback <br /> <br />4. That the addition will not adversely affect the <br />adjacent neighbor to the north; <br /> <br />5. That the addition will not substantially change <br />the character of the neighborhood. <br /> <br />BE IT FURTHER RESOLVED, that the application NC-56 is <br />hereby approved subject to the following condition: <br /> <br />1.
