I <br /> <br /> <br />-4~"":",,,, <br /> <br />RESOLUTION NO. 4625 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAM~EY <br />CITY OF NEW BRIGHTON <br /> <br />WHEREAS an application for a ~pecial use permit entitled <br />SP-I05 has been made by Minnesota ~ransportation Museum and <br />New Brighton Historical Society to use an industrial site for <br />a transportation museum site. <br /> <br />WHEREAS the procedural history of the application is as <br />follows: <br /> <br />It <br />I: <br />'( <br />L <br />;.: <br />t~ <br />I ~ <br />II <br />}' <br />Il <br />'" <br />I <br />1\ <br />~ ~ <br />I; <br />L <br />I. <br />I :~ <br />" <br />\' <br />;} <br />'. <br />" <br />f' <br />i: <br /> <br />" <br />~ ; <br /> <br />;\ <br />'I <br />I: <br /> <br />i' <br />Ii <br />d <br />I' <br />I <br />~ ~ <br />;l <br /> <br />~ ~ <br /> <br />'. <br />i:j <br />Ii <br />l' <br />I, <br />I' <br />i; <br /> <br />;. <br />iI <br /> <br />Ii <br />~ ~ <br />~ t <br />j: <br />H <br /> <br />1. <br /> <br />That an application for s~ec~al use permit, SP-I05 was <br />filed with the City of New Brighton on June 4, 1982. <br />That the Planning Commission, pursuant to published and <br />m~iled notices, held a pu~lic hearing on July 20, 1982, <br />August 17, 1982, all persqns present at the hearing <br />were given an opportunity to be heard. <br />That such application was reviewed by the City Council <br />on August 24, 1982. <br />The written comments and 1nalysis of the City staff, <br />the Planning Commission mi-nutes and recommendations were <br />considered. . <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />1. <br /> <br />That the property is zoned 1-2, Heavy Industrial with a <br />pending rezoning of 1-3, ~imited Industrial~ <br />That because of the uniqu~ness of the use and the <br />pending rezoning the applicant has filed for a special <br />use permi t~ <br />That the consideration of1the special use permit <br />establishes the foundation for future consideration of <br />the building permit appli~ation; <br />That the Planning Commiss~on is only considering the <br />use of the property pursuant to Section 8-130 of the <br />New Brighton City Code; <br />That the outside display qf vintage railroad equipment <br />for public education purpqses is not to be considered <br />outside storage; <br />That the area is zoned industrial and that the only area <br />f ' I . <br />therefore under the zon1ng code requ1rements that must <br />have concrete curbs is thEll access drive up to the first <br />building, no other drivln~/parking .area is required to <br />have curbing; I <br />That the depot building baing a historical structure on <br />display for educational purposes should be located next <br />to the ~ail line and that normal setbacks would not apply <br />in this case because the structure is a part of the site <br />landscaping; and <br />That the rail right-af-way on ,this subject property to <br />the north of the Historic Equipment Shelter is 50 feet <br />wide and zoned industrial,provides the buffer area betwee <br />the R-l park property and this site resulting in a 20 <br />foot rear yard setback requirement. <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />7. <br /> <br />8. <br /> <br />1. That the proposed buildinq meet' all applicable zoning <br />and building code require~ents~ <br />2.
