II> 1.08. Due to the pendency of an application for a special use pennit for development that . may not be consistent with future amendments to the comprehensive plan and official . 'controls and the potential for other such development, the council has determined that there is a need for an interim ordinance to be adopted pursuant to Minnesota Statues, Section 462.355, Subd. 4, for the purpose of protecting the planning process and the health, safety and welfare of the citizens of the city, and ensuring that the city and its citizens retain the benefits of, and the protection sought to be afforded by, the city's comprehensive plan and zoning ordinances until the study process is complete and any modifications to the city's comprehensive plan and zonmg ordinance become effective. Section 2. Properties Subiect to Moratorium. 2.01. Properties subject to the provisions of this moratorium include the properties described below in paragraphs 2.02 through 2.04. 2.02. Northeast Quadrant. Property bounded on the west by Silver Lake Road and on the south by Palmer Drive with street addresses 2350 Palmer Drive and 1201 Silver Lake Road. 2.03. Southeast Quadrant. Properties east of Silver Lake Road and South of Palmer Lake Drive with addresses of2397, 2299 and 2303 Palmer Drive and 1135 Silver Lake Road. .2.04. Southwest Quadrant. Properties west of Silver Lake Road and south of Palmer Drive . with addresses of 1100, 1134 and 1168 Silver Lake Road and 2655, 2677, 2633 and 2611 Palmer Drive. f Section 3. Prohibition. 3.01. Except as provided in Section 4, during the period this interim ordinance is in effect, no properties subject to the moratorium may be developed, or redeveloped and no site plan . approvals, rezonings, licenses (other than renewals), p1attings or replattings, land divisions : or consolidations, special use permits, or building permits will be considered, approved or granted by the city. Section 4. Exception. 4.01. This ordinance shall not apply to: a) developments or redevelopments that have secured all necessary approvals other than building permits; b) issuance of building permits for projects that do not require site plan approval pursuant to New Brighton City Code, Section 8-010; or c) final plat or subdivision approval that have received preliminary plat approval within one year prior to the effective date of this ordinance, provided all conditions of preliminary plat approval have been satisfied. Section 5. Effect on PendiDl! Applications. . 5.01.
