<br />II> <br /> <br />1.08. Due to the pendency of an application for a special use pennit for development that <br />. may not be consistent with future amendments to the comprehensive plan and official <br />. 'controls and the potential for other such development, the council has determined that there <br />is a need for an interim ordinance to be adopted pursuant to Minnesota Statues, Section <br />462.355, Subd. 4, for the purpose of protecting the planning process and the health, safety <br />and welfare of the citizens of the city, and ensuring that the city and its citizens retain the <br />benefits of, and the protection sought to be afforded by, the city's comprehensive plan and <br />zoning ordinances until the study process is complete and any modifications to the city's <br />comprehensive plan and zonmg ordinance become effective. <br /> <br />Section 2. Properties Subiect to Moratorium. <br /> <br />2.01. Properties subject to the provisions of this moratorium include the properties <br />described below in paragraphs 2.02 through 2.04. <br /> <br />2.02. Northeast Quadrant. Property bounded on the west by Silver Lake Road and on the <br />south by Palmer Drive with street addresses 2350 Palmer Drive and 1201 Silver Lake Road. <br /> <br />2.03. Southeast Quadrant. Properties east of Silver Lake Road and South of Palmer Lake <br />Drive with addresses of2397, 2299 and 2303 Palmer Drive and 1135 Silver Lake Road. <br /> <br />.2.04. Southwest Quadrant. Properties west of Silver Lake Road and south of Palmer Drive <br />. with addresses of 1100, 1134 and 1168 Silver Lake Road and 2655, 2677, 2633 and 2611 <br />Palmer Drive. <br /> <br />f Section 3. Prohibition. <br /> <br />3.01. Except as provided in Section 4, during the period this interim ordinance is in effect, <br />no properties subject to the moratorium may be developed, or redeveloped and no site plan <br />. approvals, rezonings, licenses (other than renewals), p1attings or replattings, land divisions <br />: or consolidations, special use permits, or building permits will be considered, approved or <br />granted by the city. <br /> <br />Section 4. Exception. <br /> <br />4.01. This ordinance shall not apply to: <br /> <br />a) developments or redevelopments that have secured all necessary approvals other <br />than building permits; <br /> <br />b) issuance of building permits for projects that do not require site plan approval <br />pursuant to New Brighton City Code, Section 8-010; or <br /> <br />c) final plat or subdivision approval that have received preliminary plat approval <br />within one year prior to the effective date of this ordinance, provided all conditions <br />of preliminary plat approval have been satisfied. <br /> <br />Section 5. Effect on PendiDl! Applications. <br /> <br />. 5.01.
