ACCEPTANCE OF ORDINANCE NO. 699 CITY OF NEW BRIGHTON, RAMSEY COUNTY, MINNESOTA ACCEPT ANCE OF GAS FRANCHISE: WHEREAS, the aty Council of the aty of New Brighton, Ramsey County, Minnesota, on the 26th day of November, 2002, passed and adopted Ordinance No. 699, entitled: AN ORDINANCE GRANTING NORTHERN STATES POWER COMPANY, DIBI A XCEL ENERGY, A MINNESOTA CORPORATION, ITS SUCCESSORS AND ASSIGNS, PERMISSION TO CONSTRUcr, OPERATE, REPAIR AND MAINTAIN IN THE CITY OF NEWBRIGTON, MINNESOTA, AGAS DISTRIBUTION SYSTEM INCLUDING NECESSARY GAS PIPES, MAINS AND APPURTENANCES, FOR THE TRANSMISSION OR DISTRIBUTION OF GAS TO THE CITY, ITS INHABIT ANTS, AND OTHERS, AND TO USE THE PUBLIC WAYS AND PUBLIC GROUNDS OF THE CITY FOR SUCH PURPOSES. which Ordinance was duly published according to law on the 4th day of December, 2002, in the New Brighton Bulletin a ne'WSpaper circulated in and setving as the legal ne'WSpaper for the aty of New Brighton, County of Ramsey, and State of Minnesota, and which Ordinance is not effective unless accepted in writing by Northern States Power Company, dlbl a Xcel Energy. NOW THEREFORE, Northern States Power Company, a Minnesota corporation, dlbl a! Xcel Energy for itself and its successors and assigns, does hereby accept all the terms and conditions of said Ordinance.
