Statutory Authority. <br /> <br />Minn~sota Statutes, Section 429.101 authorizes cities to impose charges for the cost of operating a <br />streetjlighting system and to adopt an ordinance to make this authority effective. By this Chapter, <br />the C~ y of New Brighton elects to exercise this authority. <br />1! <br />Sec. ~~-2. Street Lighting System Established. <br /> <br />A Ci~:: street lighting system is established. The system consists of all street lighting facilities <br />own by the city and all street lighting facilities for which the city purchases and supplies electrical <br />ener . <br />" <br /> <br />Sec. ~3-3. Rates and Collection of Fees. <br />Ii <br />II <br />(1) Rr,tes. The street lighting charges imposed by this Chapter will be based on land use. The City <br />Cou~~i1 will establish a flat rate for single and two-family residential properties and a flat rate for all <br />othe~ !property categories within the City's billing system. Unimproved and vacant land will not be <br />bille~ for street lighting under this Chapter. <br />:! <br />(2) a~lculation of Rates. The City Council will adopt a Resolution establishing the rate of the <br />serviqe charge for each property category. <br />'I <br />(3) ~~llection of Fees.
