<br />ORDINANCE NO. ill <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />AN ORDINANCE ADDING A NEW <br />CHAPTER TO THE CITY CODE <br />RELATING TO STREET LIGHTING <br />THE CITY COUNCIL OF THE CITY OF <br />NEW BRIGHTON ORDAINSaa follows: <br /> <br />-- .----- <br />----- <br />Section 1. The New Brighton City COde <br />is amended by adding a new Chapter 33 <br />as follows: <br /> <br />City Code <br />Chapter 33 <br />Street Lighting System <br />sec. 33-1. Statutory.AUthOrlty. <br />Minnesota Statutes, Section 429.101 <br />authorizes cities to impose charges for <br />the cost ot operating a street lighting <br />system and to adopt an ordinance 10 <br />make this authority effective. By this <br />Chapter, the City of New Brighton elects <br />to exercise this authority. <br />Sec. 33-2. Street Lighting System <br />Established. <br />A city - street lighting . system is <br />established. The system consists of all <br />street lighting facilities owned by the city <br />and all street lighting facilities for which <br />the city purchases and supplies electrical <br />energy_ <br />Sec. 33-3. Ratea and Collection of <br />Fees. <br /> <br />(1) RaMS. The street lighting charges, <br />Imposed by this Chapter will be based on <br />land use. The City Council will establish a <br />flat rate for single and lWo-fam>>y <br />residential properties and II flat rate for all <br />other property categories within the City's <br />billing system. Unimproved and vacant <br />land will not be billed for street lighting <br />under this Chapter, <br />(2) Ca/cullltlon of Rates. The City <br />Council will adopt a Resolution <br />establishing the rate of the service <br />charge for each property category. <br />(3) Collection of FMs. Street lighting <br />charges will be placed directly on the <br />quarterly utility bill for each property. <br />Sec. 33-4. Assessment of Charges. <br />Any street lighting charges that are past <br />due in excess of 90 days may be certilied <br />to Ramsey COunty for collection with real <br />estate taxes as a special assessment. <br />The City may also bring a civil action or <br />pursue other legal remedies to collect <br />unpaid charges. Charges certilied as a <br /> <br />special assessment will be collected <br />following the procedures In Minnesota <br />Statutea, Sections 429_061,429_071, and <br />429.081. ~' <br />Section 2.
