<br />(2) Such employee shall be discharged if unable to qualify for a position in an existing <br />classification or if no position is vacant. <br /> <br />i Sec. 21-15. Disciplinary Action. <br /> <br />Employees shall be subject to disciplinary action for failing to fulfill their duties and <br />I responsibilities. It shall be the policy of the City to administer disciplinary action uniformly and <br />. without discrimination. Disciplinary action may include action up to and including termination. <br />Discipline will be based upon the nature and severity of the infraction and conditions <br />surrounding the incident using, where possible, generally accepted principles of progressive <br />discipline. <br /> <br />Sec. 21-16. Disciplinary Steps. <br /> <br />The employee's immediate supervisor or Department Director shall inform the employee <br />promptly and specifically of the cause for disciplinary action. Where practicable, disciplinary <br />action against any employee shall be progressive and follow the steps contained in this Section. <br />The practicability for the situation is to be determined solely by the City or its agents. These <br />subsections are intended only to provide examples of types of discipline and are not meant to be <br />exclusive nor to require the City to exhaust these steps in any particular instance. <br /> <br />(1) Oral Reprimand. The supervisor shall inform the employee that "this is an oral reprimand" <br />and shall state the reason for the reprimand. <br /> <br />(2) Written Reprimand. The department director shall submit a written reprimand to the <br />employee and place a copy of the reprimand in the employee's personnel file. <br /> <br />(3) Suspension. The department director may suspend an employee without pay for a period not <br />to exceed three days. Notification of such suspension shall be brought immediately to the <br />I attention of the City Manager. City Manager approval is required prior to issuing a suspension <br />beyond three days. <br />
