That an application for variance, VN-223 was filed with <br />the Ci ty of New Bri ghton on Augus t 11, 1981. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on August 18, 1981. <br />3. That the City Council, pursuant to published and mailed <br />notices, held a public hearing on September 8, 1981, <br />Se p t em b e r 22, 1 9 81, and 0 c t 0 be r 1 3, 1 9 81, a 11 per son I s <br />present at the hearing were given an opportunity to be <br />heard. <br />4. The written comments and ~nalysis of the City staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />VN-223: <br /> <br />1. That under PRD #27 the applicant dedicated 5 acres of <br />land to the City of New Brighton for parks; <br />2. That the Rice Creek Watershed District required an <br />amen~ed storm water drainage plan which reduced the size <br />of the condominium property; <br />3. That the building siz~, shape and configuration on the <br />property is unique in t~dt such a Y-shaped building only <br />encroaches on the setback lines at the two corners; <br />4. That ther,eare existing R-,2, Two Family Residential <br />Developments to the west of the. proposed. b'u;ilding and <br />that more than a five (5) foot setback should be <br />required o~the western portion of the condominium site; <br />5. That the F,ire Departmentrequir:es and reCommends that the <br />applicant provide at least 15 feet on each side of the <br />building for emergency access~ <br /> <br />BE IT FURTHER RESOLVED, that the application VN-223 is and <br />hereby approved subject to the following conditions: <br />, <br /> <br />~ ~ <br />!; <br /> <br />1. That all grading, drainage, and street utilities be <br />subject td approval of the City Engineer; <br />2. That all fire hydrant locations, fire and ~mergency <br />lanes, sprinkling connections, emergency access to all <br />parts of the building, shall be provided and approved <br />by the Fire Department; <br />3. That the condominium building shall be built for <br />individual unit ownership, be of'masonary construction <br />having underground parking, and have an approved <br />sprinkling system; <br />4. That the certificates of occupancy not be issued until a <br />copy of the necessary recordable document of ownership i <br />f i 1 e d with the City B u i ld i n 9 0 f fie i a 1 ; <br />5.
