RESOLUTION NO 2473 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR VARIANCE, VN-221 WHEREAS, an application for a variance entitled VN-221 has been made by the City of New Brighton to permit the construction of an addition with less than the required number of parking spaces; and WHEREAS, the procedural history of the ~pplicat.i9n is as follows: 1. That an application for a variance, VN-221 was filed with the City of New Brighton ,on June 16, 1981'. 2. That such application was reviewed bytbe New Brighton Planning Commission Board of Review on June 22, 1981. 3. That the City .Council,pursuant to published and mailed notices, held a public hearing on July 14, 1981,al1 personts present at the hearing were given an opportunity to be heard. 4. The written comments and analysis of the City staff, the Planning Commission minutes and recommendations were considered. NOW THEREFORE BE IT RESOLVED, that the New Brighton City Council makes the following Findings of Fact in respect to VN-221: 1. That the property is zoned B-3, General Business; 2. That the existing store was developed and designed as an integral part of the Brighton Village Shopping Center in terms of access and parking accotding to a 1972 agreement; 3. That Section 12-050 m. provides for an allowance for joi nt use of a parking area; 4. That the shopping center according to the requirements of the New Brighton Zoning Code has a surplus of 105 parking spaces; 5. That the actual parking demand for the existing off-sale liquor store is minimal and of the short-tennvariety and therefore should complement the parking demand created by the proposed on-sale operation; 6. That the site is unique from restaurant'parkiilg, demands and therefore the zoning code parking requirements do not specifically apply; 7. That the site is also unique in being a part of a shopping center in that there is an existing joint use parking agreement and that the two functions are not segregated in design; 8. That a hardshi~would reiult in re~trictingdevelopment of the site by not giving consideration for the use of the adjacent parking spaces',thata,re presentlY, bei ng' used :under',theexisting JoJnt parking agreement. BE IT FURTHER RESOLVED that the application for variance, VN-22l is and hereby approved subject to the following conditions: 1. That the applicant provide a new joint parking agreement with the owners of the shopping center for overflow parking; 2. That the Liquor Director periodically monitor the parking situation and the City review the parking situation one year after the issuance of a Certi fi cate of Occupancy; and 3. That the internal circulation patterns and traffic mechanisms on the two sites be analyed and approved by the City Eng;neer.
