T hat a nap pl i cat ion for Va ria nee, V N - 21 7 was f i 1 e d <br />with the City of New Brighton on November 14, 1980. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on November 18, 1980 <br />and December 16, 1980. <br />3. That the City Council, pur~uant to published and mailed <br />notices, held a public hearing on January 13, 1981, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />4. The written comments and analysis of the City staff, the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />VN-2l7: <br /> <br />1. That the property is zoned B-3, General Business <br />and has been developed as a shopping center comprised <br />of both office and retail business uses. <br />2. That the uniqueness of the application is that the <br />site is a shopping center with rental spaces not <br />specifically designated for retail on a pre-determined <br />formula. <br />3. That a hardship results in that the strict application <br />of the parking requirements as presently exist does <br />not allow the expansion of the building nor provide <br />flexibility in regard to the changed usage of the <br />spaces within the center. <br />4. That the variance request would result in a parking lot <br />comparable to the other shopping center within New <br />Brighton on the basis of total gross floor-area <br />to parking spaces provided. <br />5. That the Council has recognized that in specific areas <br />of the City that strict application of the existing <br />parking regulations there has been excessive land <br />area utilized by parking and directed a revision <br />to those regulations; and that implementation of <br />those revisions recommended by the Planning <br />Commission if made a part of the code would eliminate <br />the need for this variance application. <br /> <br />BE IT FURTHER RESOLVED, That the application VN-217 is <br />and hereby approved subject to ~he following conditions: <br />
