".,,; <br /> <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />~. =r <br /> <br />Cr <br /> <br />ORDINANCE NO. 6/, I, <br /> <br />AN ORDINANCE AMENDING CHAPTER 17 (NUISANCES) OF THE NEW BRIGHTON CITY <br />CODE RELATING TO NOISE CONTROL; AND AMENDING CHAPTER 29, ARTICLE IV, <br />SECTION 29-46 (SNOWMOBILE HOURS OF OPERATION) <br /> <br />The City Council of New Brighton ordains: <br /> <br />Section I. New Brighton City Code Section 17-12 is repealed and the following Sections <br />17-12 through 17-14 are added: <br /> <br />Section 17-12. NOISES PROHIBITED. <br /> <br />Subdivision 1. General prohibition. No person shall make or cause to be made any <br />distinctly and loudly audible noise that unreasonably annoys, disturbs, injures, or <br />endangers the comfort, repose, health, peace, safety, or welfare of any person or <br />precludes their enjoyment of property or affects their property's value. This general <br />prohibition is not limited by the specific restrictions of the following subdivisions. <br /> <br />Subd. 2. Horns, audible signaling devices, etc. No person shall use any audible <br />signaling device on any vehicle except as a warning of danger, as required by Minn. Stat. <br />169.68. <br /> <br />Subd. 3. Motor vehicles. No person shall operate a motor vehicle in the city in <br />violation of the motor vehicle noise limits of the Minnesota Pollution Control Agency. <br />(Minn. Stat. 169.693) <br /> <br />Subd. 4. Defective vehicles or loads. No person shall use any vehicle so out of <br />repair or so loaded as to create loud and unnecessary grating, grinding, rattling, or other <br />noise. <br /> <br />Subd. 5. Exhaust. No person shall discharge the exhaust or permit the discharge <br />of the exhaust of any steam engine, stationary internal combustion engine, motor boat, <br />recreational vehicle, water craft, or snowmobile except through a muffler or other device <br />that effectively prevents loud or explosive noises therefrom and complies with all <br />applicable state laws and regulations. <br /> <br />Subd. 6. Loading, unloading, unpacking. No person shall create loud and excessive <br />noise in loading, unloading, or unpacking any vehicle. <br /> <br />Subd. 7. Participation in noisy parties or gatherings. <br /> <br />(a) No person shall congregate at, or participate in, any party or <br />gathering of people from which noise emanates of a sufficient <br />volume or of such nature to unreasonably disturb the peace, quiet, or <br />repose of other persons. <br />
