<br />AN ORDINANCE AMENDING CHAPTER e.
<br />ANIMALS AND FOWL, OF THE CITY CODE.
<br />It is hereby ordalned:
<br />Chapter 6 of the City Code Is hereby
<br />amended as follows:

<br />Sec. 6-1. Definitions.
<br />For purposes of thiS chapter, the following I
<br />,words and phrases shall have the meanings .
<br />respectively aecribed to them:
<br />At I.....: Off the premises of the owner and
<br />not under the physical control, by leash or
<br />othilfWlse, of the owner, a member of the
<br />owner's family. 01' a. person designated' by the
<br />,owner.
<br />e.t: A domesticated feline animal, Including'
<br />both male and female.
<br />City: Area within the corporate limits of the
<br />City of NIIMI BrIghton,
<br />Do,: A domesticated canine animal,
<br />Including both male and female.
<br />~.I: Any place where more than three
<br />(3) dogs or more than three (3) cats or any
<br />combil\Qtion of more than three (3) cats and
<br />dogs arek!lPl on the same premises except a
<br />::;; kiten8 or pups may be lap for six (6)

<br />Large animal: Horses, !tonles, donkeys;-
<br />cows, bulls and other similar sized
<br />domesticated aJ'limals. .
<br />o.ner: Any person owning or haItIoring an
<br />animal coming under the provisions of this
<br />ordinance.
<br />RESTRAINED: BEING EFFECTIVELY
<br />CONTFlOLLED BY VOICE COMMANDS BY
<br />AN INDIVIDUAL, BY TRAINING, OR
<br />CONTROLLED BY AN ELECTRONIC
<br />DEVICE.
<br />Sub8tantlal bodily h8rm: A temporary but
<br />substantial disfigurement or a temporary
<br />substantial \o880tlmpllltTnei'ltof thefunctlons
<br />of any bodily mert1be1' or organ, ora fracture
<br />of any bOdily member. .
<br />VIcloua Ani"": Any animal of a ferOCiOUS
<br />or vlclous character, habit. or disposltion, or
<br />any animal which has /
<br />1) without provocation 1n1Iict8d substantial
<br />bOdily harm on .a human being,
<br />2) . killed a domestic animal without
<br />provocation, or
<br />3) has been Involved In two (2) or more
<br />unprovoked biting incidents, involving humans
<br />or. domestic anlmala, within one year.
<br />Sec. 6-2. Diseased Animals.
<br />No person shall keep Or suffer to be kept on
<br />his PJ~rolse.s occupied by him, or permit or
<br />suffer to run at large any diseased antmal.
<br />Sk 6-3. V1eious Animals.
<br />No person shall keep or suffer to be kept on
<br />his premises occupied by him, or permit or
<br />suffer to run at Iarge.any vicious animal.'
<br />Upon convlclion for violations of this ~,
<br />the court may In addition to Imposition of
<br />sentence, direct the animal controloflicer' to .
<br />take the animal into custody and forthwith
<br />dispose of It in'a humen& manner.
<br />Sec. 6,4. Cruelty to Animals.
<br />No person shall inhumanely, unrlecessarlly
<br />and cruelly or WIlntonty. beat, Injure, torment
<br />or otherwise abuse an animal or cause or
<br />permit an ,animal fight.
<br />Sec. 6.S. Kennela.
<br />No person shall maintain in this city a
<br />kenne.l except in compliance with the
<br />provisions.of the zoning ,ordinance.
<br />Sec. 6-6. Penalty.
<br />Any person convicted of any violation. of this
<br />chapter shall be guilty of a misdemeanor.

<br />ARTICLE II. DOGS
<br />Sec. 6-16. Confinement.
<br />A. No person having the custody or control
<br />of any dog or animal of the dog kind shall
<br />permit the same to be on any unfenced,
<br />privately owned. land without being elrectiYeIy
<br />restfalned from beyOnd such uilfenced land,
<br />nor st'lall any person' heVlng theeuelDdYor
<br />controtof any dog or animal of the dog kind
<br />permit the aame at any time to be on any
<br />street, public park, schOOl grounds or public

<br />B. NO CITATION WILL BE ISSUED BY THE
<br />CITY UNLESS IT IS SHOWN TO THE
<br />ISSUING OFFICER THAT AN INDIVIDUAL,
<br />OR SOMEONE ACTING ON THEIR BEHALF,
<br />HAS GIVEN NOTICE TO THE OWNER OR
<br />KEEPER OF THE DOG THAT THE DOG
<br />HAS NQ;: BEEN A&;TRAIJI&&' AT LARGE
<br />ON AT LEAST ONE PRIOR OCCASION OR
<br />UNLESS THE ISSUING OFFICER

<br />Sec. 6-17. Cleanup.
<br />Any person having thll custody or control of
<br />any dog shall:
<br />
<br />A. Not permit the dog- to be on pUbliC
<br />property or the property of another without
<br />having In their Immediate possession a device
<br />.tot the colIecllon and removal of feceI and a
<br />cOntainer for the transport of the feces to a
<br />pioper receptaoIe.
<br />B.Remove feces left by a dog on pllblic
<br />propeny or the pIOp8rty of another to a proper
<br />I~ located on the custodian's property
<br />or that of the dog owner, axceptthat
<br />droppings in a park may be placed in an
<br />outsidepllf1c trash container,
<br />C. The provisions of this aectlon shall not
<br />apply to guide dogs accompanying a blind
<br />person or to a person With dogs engaged. In

<br />Sec. 6-18. Howling and Barking.
<br />It shall be unlawful for any person to/;lWl'l,

<br />dog which, by frequent and habitUal howling, .

<br />Sec. 6-45.. Confinement.
<br />A. No person having the custody or control
<br />of any cat or animal of the cat kind shall
<br />parmit the same to be on any unfenced,
<br />privately owned land withOUt being 8ffecllvely
<br />restrained from beyond such unfenced land,
<br />nor shall any person having the custody or
<br />control of any cat or animal of the cat kind
<br />permit the same at any time to be on any
<br />street, public park, achool grounds, .property
<br />of another, or public place without being

<br />Sec. 6-46. Damage to property, crying and
<br />mewing.
<br />It shall be unlawful for any person to 0W!l,

<br />cat which damages property, plantings or
<br />structures, or Which scratches or bitea
<br />persons while at large, or which habitually
<br />cries or mews to the reasonable annoyance of
<br />another.

<br />been vaccinated with an anti.rabies vaccine
<br />

<br />same, if not requested by alic~"sed
<br />education or scientific institution under
<br />Minnesota Statutes 35.71. All SlJmS reCeived
<br />above the costs. and tax shall bill plac,d by
<br />the clerk in the general fund oHhe ~. Any
<br />dog or cat which is not claimed by the i:)wner

<br />All impounded dogs or cats. shah be
<br />redeemed within five (5) days, rl(\tlnClUdlng
