<br />.... <br />... <br /> <br />ORDINANCE NO. 621 <br /> <br />State of Minnesota <br />County of Ramsey <br />City of New Brighton <br /> <br />AN ORDINANCE RELATING TO THE UCENSURE OF <br />THERAPEUTIC MASSAGE SALONS~ AMENDING NEW <br />BRIGHTON CITY CODE SECTION 15.199, PARAGRAPH (2). <br /> <br />THE CITY COUNCn.. OF THE CITY OF NEW BRlGHTON ORDAINS AS FOLLOWS: <br /> <br />Section 1. New Brighton at}' Code Section 15-199 paragraph (2) is amended as follows: <br /> <br />(a) A business license for businesses other than therapeutic massage salons shall be <br />issued only for property zoned B-3. General Business; I-I, Light Industrial; or 1-2. <br />Heavy Industrial; provided that such use is not detrimental to existing and future <br />development. Business licenses for therapeutic massage salons may be issued <br />only for property zoned B.2. Neighborhood Business; B-3, General Business; 1-1. <br />Light Industrial; R-l, Single Familv Residence: or 1-2. Heavy Industrial. subject <br />to the following conditions: <br /> <br />(i) The business license may be for a principal use only if all persons <br />providing massage on tho premises have furnished a certificate or <br />diploma from a recognized school, which certificate or diploma <br />required a resident course of study of at least five hundred (500) <br />hours. <br /> <br />(ii) The business license may be for a use which is accessory to a <br />primary use of the licensed premises as a barber shop. hair or <br />beauty salon, or licensed (:osmetology salon provided all of the <br />following conditions are met (1) the primary use has at least the <br />equivalent of two full~rime employees engaged in the primary <br />business use; (2) no mOle than fift.een (15) percent of the premises <br />is devoted to the massage use; (3) the primary use has a capital <br />invesunenl in furnitm.~. fixtures and equipment of at least thirty <br />tltousand dollars (S30,OOO}; and (4) the primary use has been in <br />business in the City for at least three (3) years. <br /> <br />{ill} A ll~~s license may be ~a.nted in an R.l, Sin~e FamiJy- <br />Residential District 9..n!Y.J..~,r a U~ which is accesSOry to a orirnaci <br />Mgu1f thl"~nsed p~~s as~l'l;, Q~ber shoo, hair QLbeautv s~ <br />or.1icens!4 ~smetolo~y salor.. ~blect to the followin2 cOJl.ditions: <br /> <br />(1 ) aJl.fQndit!.Q!!.~_nLPjifagra~mJtt@ above ate ll\es. <br />
