<br />:.;1,. ~ <br /> <br />"'4 <br />r~ . <br /> <br />ORDINANCE NO. ---1l.l.B. <br /> <br />S tate of Minnesota <br />County of Ramsey <br />City of New Brighton <br /> <br />AN ORDINANCE PLACING A MORA TORlUM ON THE <br />ENLARGEMENT, ERECflON OR RELOCA nON OF <br />BILLBOARDS WITHIN THE CITY OF NEW BRIGHTON <br /> <br />THE CITY COUNCIL OF THE CITY OF CITY OF NEW BRIGHTON ORDAINS AS <br />FOLLOWS: <br /> <br />Section I. <br /> <br />Background. <br /> <br />1.01. On October 5, 1995, the City Council enacted a moratorium on construction of <br />billboards within 200 feet of a property line and scheduled a public hearing before the New <br />Brighton Planning Commission to consider amendments to the City's Code relating to billboards. <br /> <br />1.02. On November 21, 1995, the Planning Commission conducted the scheduled public <br />hearing and reviewed information provided by City staff and members of the public. <br /> <br />1.03. The information provided by City staff and the public at the November 21, 1995 <br />public hearing brought to the Planning Commission's attention the fact that the portions of the <br />Code relating to billboards, and the proposed amendments thereto, may not be in harmony with <br />other portions of the Code, and may not adequately protect the public health, safety and welfare <br />of the citizens of the City. <br /> <br />1.04. The Planning Commission has recommended that the City Council adopt a <br />moratorium on billboard construction within the City pending review of the portions of the Code <br />relating to billboards. <br /> <br />1.05. The City intends to conduct the necessary public hearings before the Planning <br />Commission and the City Counc.il to consider amending the provisions of its Code. <br /> <br />1.06. Minnesota Statutes, section 462.355, subd. 4 permits the adoption of interim <br />ordinances pending a hearing to consider amendment of a zoning ordinance. <br /> <br />1.07. The City Council finds that adoption of such an interim ordinance is necessary to <br />protect the planning process and the health, safety and welfare of the citizens of the City. <br /> <br />Section 2. Prohibition. <br /> <br />2.01. During the period that this interim ordinance is in effect, no billboard may be <br />enlarged, erected or relocated within the City of New Brighton. <br /> <br />DJG97183 <br />NE136-8 <br />
