<br />..: <br /> <br />',.. <br /> <br />... <br /> <br />!i <br />[, <br /> <br />RESOLUTION NO 2354 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR NON-CONFORMING USE PERMIT NC-46 (generally east of 8th <br />Avenue NW and north of 1st Street SW) <br /> <br />WHEREAS, An application for a non-conforming use permit <br />entitled Nc-46 has been made by Industrial Sprinkler, <br />Corporation to permit the construction of an office addition <br />on a site with existing Type IV non-conformities. <br /> <br />WHEREAS, The procedural history of the application is as <br />:.: fo 11 ows : <br />i ~ <br /> <br />That an application for non-conforming use permit, <br />Nc-46 was filed with the City of New Brighton on <br />June 5, 1980. <br />That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on June 17, 1980 <br />and July 15, 1980. <br />That the City Council, pursuant to published and <br />mailed notices, held a public hearing on July 22, <br />1980, all person's present at the hearing were <br />given an opportunity to be heard. <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />1 . <br />2 . <br />.. <br />3. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-46: <br /> <br />i <br /> <br />1. That the property is zoned 1-2, Heavy Industrial; <br />2. That there are the following existing Type IV <br />non-conformities: <br />A. Lack of concrete curbing along the western <br />portion of the western driveway; <br />B. Outside storage of parts and debris not screened <br />from the public right-of-way; <br />C. Front yard parking less than 15 feet from the <br />street right-of-way; <br />D. Side street yard parking; and <br />E. Lack of decorative block on the street sides of <br />the building. <br />3. That the applicant address the existing Type IV non- <br />conformities by removing a portion of bituminous <br />surface in the front yard and installing a temporary <br />concrete curb. <br />4. That expansion of the non-conforming exterior wall <br />treatment meets the warrants of a variance because <br />the addition is small in size and a hardship would <br />result in having to modify the exterior of the <br />building. <br /> <br />BE IT FURTHER RESOLVED, That the application Nc-46 is <br />and hereby approved subject to the following condtions: <br />
