<br />.t." <br /> <br />, <br />q <br /> <br />RESOLUTION NO 2353 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR NON-CONFORMING USE PERMIT, Nc-47 <br /> <br />I <br />r <br /> <br />" <br /> <br />II <br /> <br />" <br />" <br /> <br />WHEREAS, An application for a non-conforming use permit <br />entitled Nc-47 has been made by Cowin and Company, Inc. to <br />permit the construction of an addition to an office building <br />on a site with existing Type IV non-conformities; and <br /> <br />WHEREAS, The procedural history of the application is as <br />f 011 ows : <br /> <br />;" <br />, <br />Ii <br />;i <br />i; <br />il <br />n <br /> <br />1. That an application for non-conforming use permit, Nc- <br />47 was filed with the City of New Brighton on July 7, <br />1980. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on July 15, 1980. <br />3. That the City Council, pursuant to published and <br />mailed notices, held a public hearing on July 22, 1980, <br />all person's present at the hearing were given an <br />opportunity to be heard. <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />;1 <br />jj <br />n <br />i' <br />n <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the fOllowing Findings of Fact in respec to Nc-47: <br /> <br />1. That the property is zoned 1-2, Heavy Industrial; <br />2. That there are the following existing Type IV non- <br />conformities: <br />A. Less than required side yard setback; <br />B. Lack of acquired concrete curbing along the <br />western edge of westerly driveway; <br />c. Lack of the required handicap parking spaces (2 are <br />requi red). <br />D. Outside storage not properly screened from the public <br />right-of-way. <br />E. Lack of required exterior wall treatment. <br />3. That if the applicant conforms with the conditions <br />established in this resolution, the intention of the <br />non-conforming use permit will be met. <br /> <br />n <br /> <br />BE IT FURTHER RESOLVED, That the application NC-47 is and <br />hereby approved subject to the following conditions: <br /> <br />1. That slats be installed in the southern and eastern <br />chain link fence; <br />2. That there be no outside storage of parts, material <br />and/or debris in undesignated storage area; and <br />3.
