<br />v <br /> <br />'~I <br />! <br />I <br /> <br />~ ~ <br /> <br />RESOLUTION NO 2350 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR SPECIAL USE PERMIT, SP-93 AND PRELIMINARY PLAT, PL-122 <br /> <br />WHEREAS, An application for a special use permit, SP-93 <br />and preliminary plat, PL-122 has been made by HFA Investments <br />to allow the platting and construction of a four unit town- <br />house on a site zoned R-2, Two Family Residential, and <br /> <br />WHEREAS, The procedural history of the application is <br />as follows: <br /> <br />1. That an application for a special use permit and <br />preliminary plat was filed with the City of New <br />Brighton on June 5, 1980. <br />2. That such application was reviewed by the New <br />Brighton Planning Commission Board of Review <br />on June 17, 1980. <br />3. That the City Council, pursuant to published and <br />mailed notices, held a public hearing on July 22, <br />1980, all person's present at the hearing were <br />given an opportunity to be heard. <br />4. The written comments and analysis of the City <br />staff, the Planning Commission minutes and <br />recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />SP-93 and PL-122: <br /> <br />1. That the property is zoned R-2, Two Family Residential; <br />2. That the site is approximately one acre in size and <br />the four units are within the allowed denisty in <br />an R-2 District; <br />3. That the site plan provides for a design and layout <br />of the units that are compatible with surrounding <br />development; <br />4. That the Comprehensive Plan states that this area <br />provide for a buffer between the single family <br />dwellings and apartment complex and this <br />development provides such a buffer without <br />adversely affecting adjacent single family <br />development; <br />5. That all parking and driving areas are located on <br />the eastern portion of the property and are <br />therefore removed from the single family development; <br />6. That the platting of the property meets all City <br />and zoning code requirements in regard to lot <br />dimension and setbacks, and <br />7. That the platting of the property provides for <br />separate legal descriptions for each unit <br />allowing for owner-occupied units. <br /> <br />AND BE IT FURTHER RESOLVED, That the application SP-93 and <br />preliminary plat PL-122 is hereby approved subject to the <br />following conditions: <br /> <br />I <br />i <br />I <br />1- <br />
