<br />.... <br /> <br />II <br />~l <br /> <br />RESOLUTION NO 2338 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAf4SEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR VARIANCE, VN-214 <br /> <br />:' WHEREAS, An application for a variance entitled VN-214 has <br />been made by J.A. Cadwallader to allow a greater density under <br />a Planned Residential Development with a dedication of park <br />property. <br /> <br />WHEREAS, The procedural history of the application is as <br />follows: <br /> <br />1. That an application for variance, VN-214 was filed with <br />the City of New Brighton on March 11, 1980. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on March 18, 1980. <br />3. That the City Council, pursuant to published and mailed <br />notices, held a public hearing on June 10, 1980, all <br />person's present at the hearing were given an opportunity <br />to be heard. <br />4. That the PRO proposal being considered shows a dedication <br />of 4.85 acres for park land. <br />5. The written comments and analysis of the City staff, the <br />i! Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Birghton City <br />Council makes the following Findings of Fact in respect to <br />VN-214. <br /> <br />1. That the property is presently zoned R-l, Single Family <br />Residential; <br />2. That the development site is 4.13 acres. <br />3. That based on the development site under PRO density the <br />maximum allowed number of units would be 22 units; <br />4. That the requested density is compatible with surrounding <br />development; and <br />5. That the proposal is consistent with the intentions of <br />the PRD ordinance in terms of efficient use of the land <br />and the protection of the health and welfare. <br /> <br />BE IT FURTHER RESOLVED, That the application for variance, <br />VN-2l4 is and hereby approved subject to the conformance with <br />Council Resolution Number 2303 approving Preliminary Planned <br />Residential Development, PRD #30. <br /> <br />n <br />;) <br />i <br /> <br />Adopted this lOth <br /> <br />day of <br /> <br />June <br /> <br />1980. <br /> <br />ATTEST: <br /> <br />_-~ t.-QiL._. / <br />_..--,V.ern~on ~c.
