<br />'--:J ......~ <br /> <br />ORDINANCE NO. 613 <br /> <br />AN ORDINANCE PLACING A MORATORIUM ' <br />ON THE CONSTRUCTION OF <br />BILLBOARDS WITHIN 200 FEET OF <br />ANY PROPERTY LINE IN A RESIDENTIAl <br />D/lTRICT. <br />THE CITY COUNCIL OF THE CITY OF NEW <br />BRIGHTON OROAINS AS FOllOWS: <br />Section 1. a.ctgrouncl. <br />1.01. Section 9-130 of the Code requireS that <br />billboards be at least 200 feet {rom any proper- . <br />ty lina In a residential district or be buffered In <br />accordance with applicable district re- <br />quirements as if the billboard con,stituted a <br />structure. <br />1.<i2. The City Council has become aware <br />that (tonstruction of a billboard is plllnned less <br />than 200 feet from a property line in a residen- <br />tial ~istrlct. <br />l.ti3. The City Council flnds that the alter: <br />native of providing such buffering as is normally <br />provided for other permitted structures may not <br />ade!.1uately obtain optimum Illnd use, promote <br />heelth, safety, order, convenience, and general. <br />welfare, or preserve property values in residen- <br />tial districts. <br />1~04. Prohibition. <br />DUring the period that this Interim ordinance <br />is in effect, no billboard may be constructed <br />c10sar than two hundred (200) feet to any pro- <br />perty line in a reSidential district.' <br />During the period that this interim ordinance . <br />is in effect no applications for licenses or per. <br />mils, for billboards closer than two hundred <br />(200) feet to any property line in a reSidential <br />dl$lflct shall be accepted or processed and no <br />sue~ licenses or permits shall be Issued. <br />Section 3. Enforcement. <br />The City may enforce any provision of this or- <br />din"nce by mandamus, injunction or any other <br />appropriate ctvll remedy in any court of com. <br />petent jurisdiction. <br />Section 4. Effective Date.. <br />4.01. This ordinance is effective the date <br />following its publication. <br />4'.02.
