'--:J ......~ ORDINANCE NO. 613 AN ORDINANCE PLACING A MORATORIUM ' ON THE CONSTRUCTION OF BILLBOARDS WITHIN 200 FEET OF ANY PROPERTY LINE IN A RESIDENTIAl D/lTRICT. THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON OROAINS AS FOllOWS: Section 1. a.ctgrouncl. 1.01. Section 9-130 of the Code requireS that billboards be at least 200 feet {rom any proper- . ty lina In a residential district or be buffered In accordance with applicable district re- quirements as if the billboard con,stituted a structure. 1.<i2. The City Council has become aware that (tonstruction of a billboard is plllnned less than 200 feet from a property line in a residen- tial ~istrlct. l.ti3. Prohibition. DUring the period that this Interim ordinance is in effect, no billboard may be constructed c10sar than two hundred (200) feet to any pro- perty line in a reSidential district.' During the period that this interim ordinance . is in effect no applications for licenses or per. mils, for billboards closer than two hundred (200) feet to any property line in a reSidential dl$lflct shall be accepted or processed and no sue~ licenses or permits shall be Issued. Section 3. Enforcement. The City may enforce any provision of this or- din"nce by mandamus, injunction or any other appropriate ctvll remedy in any court of com. petent jurisdiction. Section 4. Effective Date.. 4.01. This ordinance is effective the date following its publication. 4'.02. This ordinance shall expire December 16,.1995, unless earlier repealed or extended by the City Council.
