<br />'..-i <br /> <br />i, <br /> <br />\ <br />r <br />i <br />I <br />I <br /> <br />",- <br /> <br />RESOLUTION NO. 2297 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION DELINEATING THE RESPECTIVE POWERS AND DUTIES OF THE <br />ADVISORY BOARD AND THE PLANNING STAFF. <br /> <br />WHEREAS 472A.ll, subdivision 3, Minnesota Statutes requires <br />the City Council to delineate the respective powers and duties <br />of the Advisory Board and the planning staff, <br /> <br />WHEREAS said resolution also must establish reasonable time <br />limits for the approval by the Advisory Board of the phasing of <br />the program and provide a mechanism for appealing to the City <br />Council for a final decision when conflicts arise between the <br />Advisory Board and the planning staff regarding the development <br />program in its initial and subsequent stages, <br /> <br />THEREFORE BE IT RESOLVED that the city Council delegates to <br />the Advisory Board the respective powers and duties: <br /> <br />a. To provide a recommendation to the City Council on the <br />designation of a boundary of a municipal development <br />district incorporating an area which substantially <br />includes old downtown New Brighton. <br />b. To recommend to the City Council the various phases of <br />the development program required in order to fully <br />implement Chapter 472A Minnesota Statutes. <br />c. To advise the City Council and the administrator of the <br />development district, as appropriate, on the planning, <br />construction and implementation of the development I <br />program, and maintenance and operation of the development <br />district after the program has been completed. <br />d. To initiate a review of the development district boundary <br />and the, phases of the development program within ten (lO)L <br />days after so directed by the City Council on the develoP, <br />ment district boundary and the phases of the development I <br />program within forty-five (45) days after the program i <br />draft is presented to the Advisory Board. i <br />I <br />! <br />THEREFORE BE IT RESOLVED that the respective powers and dutief <br />of the planning staff are as provided by the Municipal Code, I <br />Administrative Code, and current practice. I <br /> <br />BE IT FURTHER RESOLVED that in the event of a conflict betwee~ <br />the Advisory Board and the planning staff regarding the developmen, <br />program in its initial and subsequent stages, that the point of . <br />, conflict shall be referred to the city Council for resolution.
