<br />~. <br /> <br />'L. <br /> <br />)- <br /> <br />ORDINANCE NO. 611 <br />AN ORDINANCE PLACING A MORATORIUM ON THE <br />CONSTRUCTION OF BILLBOARDS WITHIN 200 FEET OF <br />ANY PROPERTY LINE IN A RESIDENTIAL DISTRICT. <br /> <br />~ <br /> <br />'" <br /> <br />,~ <br /> <br />THE CITY COUNCIL OF THE CITY OF CITY OF NEW BRIGHTON ORDAINS AS <br />FOLLOWS: <br /> <br />Section 1. Backi:1'ound. <br /> <br />1.01. Section 9-130 of the Code requires that billboards be at least 200 feet <br />from any property line in a residential district or be buffered in accordance with <br />applicable district requirements as if the billboard constituted a structure. <br /> <br />1 .02. The City Council has become aware that construction of a billboard is <br />planned less than 200 feet from a property line in a residential district. <br /> <br />1.03. The City Council finds that the alternative of providing such buffering <br />a.s is normally provided for other PElrmitted structures may not adequately obtain <br />optimum land use, promote health, safety, order, convenienoe) and general welfare , <br />or preserve property values in re$iqential distriots. <br /> <br />1.04. The City intends to conduct tbe necessary public hearings to consider <br />amending the pl'Ovisions of its Code 'relating to buffering for billboards. <br /> <br />1 .05. A hearing on such amendments is hereby licheduled for November 21, <br />1995 before the New Brighton Planning Commission. <br /> <br />1.06. Minnesota Statutes, section 462.355, subd. 4 permits the adoption of <br />interim ordinances pendini a hearing to oonsider amendment of a zoning ordinance. <br /> <br />1.07. The City Council finds that adoption of such an interim ordinance is <br />necessuy to protect the planning process and the health, safety and welfare of the <br />citizens of the City. <br /> <br />Section 2. Prohibition. <br /> <br />During the period that this interim ordinance is in effect, no billboa.!'d may be <br />constructed closer than two hundred. (200) feet to any property line in a residential <br />district. <br /> <br />During the period that this interim ordInance is in effect no applications for <br />licenses or permits for billboards closer than two hundred (200) feet to any property <br />line in a residential district shall be accepted or processed and no such licen5es or <br />permits shall be issued. <br /> <br />Section 3.
