<br />.! <br />., <br /> <br />ORDINANCE NO. 611 <br /> <br />AN ORDINANCE AMENDING PORTIONS <br />OF CHAPTER 7 OF THE NEW BRIGHTON <br />CITY CODE: ADOPTING BY REFERENCE <br />THE MINNESOTA STATE BUILDING <br />COOl AND RELATED CODES AND <br />MATERIALS: AND PROVIDING FOR THEIR <br />ADMINISTRATION AND ENFORCEMENT. <br />The City Council of New Brighton does ordain: <br />1. Section 7-1 of the New Brighton City Code <br />entitled "Building code - Adopted" is amend- <br />ed to read as follows: <br />Section 7-1. Building code - Adopted. <br />The Minnesota state building code, one copy <br />of which is on file in the office of the city clerk <br />has been adopted by Minnesota Statutes, Sec- <br />tions 16B.59 through 16B.75. as a uniform <br />building code applicable throughout the stale. <br />The 1994 edition of the state building code, as <br />amended, is hereby adopted by reference as <br />the building code of the city and incorporated <br />in this chapter as completely as if set out in full. <br />The 1994 edition of the state building code <br />adopts by reference certain codes, appendices, <br />standards and supplemental materials are <br />adopted by reference and incorporated into this <br />code as if fully set out al this point: <br />a. 1300 Minnesota Building Code <br />b. 1301 Building OffICial Certification <br />c. 1302 State Building Construction <br />Approvals <br />d. 1305 Adoption of the 1994 Uniform <br />Building Code Including Appendix <br />Chapters: <br />1. 3, Division I, Detention and <br />Correctional Facilities <br />2. 12, Division II, Sound Transmission <br />Control . <br />3. 29, Minimum Plumbing Fixtures <br />e. 1307 Elevators and Related Devices <br />f. 1325 Adoption of the 1993 National <br />Electrical Code <br />g. 1325 Solar Energy Systems <br />h. 1330 Fallout Shelters <br />I. 1335 Flood proofing Regulations <br />j. 1340 Facilities for the Handicapped <br />k. 1346 Adoption of Ihe 1991 Uniform <br />Mechanical Code <br /> <br />t <br /> <br />\~ <br /> <br />~ <br /> <br />.. <br /> <br />, <br /> <br />I. 1350 Manufactured Homes <br />m. 1360 Prefabricaled Buildings <br />n. 1365 Snow Loads <br />o. 1370 Storm Shelters <br />p. 4715 Minnesota Plumbing Code <br />q. 7670 Minnesota Enltrgy Code <br />2. SectiOn 7-2 of the New BrigMon City Code <br />entitled "Same - OPtional appendices." Is <br />amended to read as follows: <br />Section 7.2. Same - Optional appendlcn <br />and chapter.. <br />The following appendices, standards and <br />supplemental materials are not a mandatory <br />part of the code but are adopted by reference <br />for the City and are incorporaled into Ihis or- <br />dinance as completely as if set out in full: <br />a. Appendix chapter 3. DiviSion 1 and 2 <br />b. Appendix chapter 4, Division I and III <br />c. Appendix chapter 33 <br />d. 1306 Special Fire Protection, Option 8 <br />8. 1310 Building Security <br />3. Section 7-4 of the New Brighton City Code <br />entitled "Organization and Enforcement." Is <br />amended to read as follows: <br />Section 7-4. Organization and entoreement. <br />The application. administration and enforce- <br />ment of the code shall be in accordlltlce with <br />Minnesota rule part 1300.2100 and as modified I <br />by chapter 1305. The code shall be enforced <br />within the extraterritorial limits permitted by <br />Minnesota statute 168.62 Subdivision 1 when <br />so establiShed by this ordinlltlce. <br />The community development department <br />shall be the building code department of the cj. <br />Iy. The administrative authority shall be a state <br />certified "building official, class II" as prescrib- <br />ed by Minnesota statute 16B.65. <br />The appointing autllority shall be the city <br />manager. <br />4. Section 7,16 of the New Brighton City <br />Code entitled "Permits, inspections and fees." <br />is amended to read as followS: <br />Section 7-16. Penntta, lnapecti0n8 and fee.. <br />The issuance of permits and the collection <br />of fees shall be as authorized in Minnesota <br />statute 16B.62 subdivision 1 and as provided <br />for in chapter 1 of the 1994 Uniform Building <br />COde and Minnesota rules parts 1305.0106 and <br />1305.0107. <br /> <br />Permit fees shall be assessed for work <br />governed by this code in accordance with l'iec. ; <br />tion 7.18. In addition, a surcharge fee shaltbe . <br />eoIlectedon all permits issued for work govern- <br />ed by thia code in accordance with Minnesota <br />statute 18B.70. <br />5. sectiOn 7-19 of the New Brighton Cily <br />Code entitled "Violations and penalties". is <br />amended to read as follows: . . <br />Section 7.19. Z <br />A violatiOn of the code is a misdemeanorS In ; <br />keeping with Minnesota Statutes 609.02 the <br />maximum penally is a fine of $700 and/or Im- <br />prisonment for ninety (90) days.
