<br />1'~. <br />, <br /> <br />. , <br /> <br />~ <br /> <br />; <br /> <br />CITY OF NEW BRIGHTON <br /> <br />~-- <br />-, <br /> <br />ORDINANCE NO. i2.L <br /> <br />AN ORDINANCE PROVIDING FOR THE LICENSURE OF <br />PAWNBROKERS AND SECONDHAND DEALERS; ADDING <br />NEW CODE SECTIONS 15-450 THROUGH 15-482 <br /> <br />The City Council of the City of New Brighton ordains that the New Brighton <br /> <br />Code of Ordinances is hereby amended by adding sections 15-450 through 15-482 as <br /> <br />follows: <br /> <br />ARTICLE XIII <br />PAWNBROKERS AND SECONDHAND DEALERS <br /> <br />Section 15-450. DEFINITIONS. For the purpose of Sections 15-450 through <br />15-482, the terms defined in this section have the meanings given them. <br /> <br />1. Pawnbroker means a person who loans money on deposit or pledge of <br />personal property, or other valuable thing, or who deals in the <br />purchasing of personal property or other valuable thing on condition <br />of selling the same back again at a stipulated price, or who loans money <br />secured by chattel mortgage on personal property, taking possession <br />of the property or any part so mortgaged. <br /> <br />2. Secondhand Goods Dealer means a person whose regular business <br />includes selling or receiving tangible personal property (excluding <br />motor vehicles) previously used, rented, owned or leased. <br /> <br />Section 15-451. EXEMPTIONS. Sections 15-450 through 15-482 shall not apply <br />to or include the following. <br /> <br />1. The sale of secondhand goods where all the following are present. <br /> <br />a. The sale is held on property occupied as a dwelling by the seller <br />or owned, rented or leased by a charitable or political <br />organization; <br /> <br />b. The items offered for sale are owned by the occupant; <br /> <br />c. That no sale exceeds a sale of 72 consecutive hours; <br /> <br />d. That no more than four (4) sales are held in any 12-month <br />period; <br /> <br />e. That none of the items offered for sale shall have been purchased <br />for resale or received on consignment for the purpose of resale. <br /> <br />2. The sale of goods at an auction held by an auctioneer. <br /> <br />3. The business of buying or selling only those secondhand goods taken <br />as part or full payment for new goods and where such business is <br />incident to and not the primary business of a person. <br />
