<br />to <br /> <br />, f. <br />" <br /> <br />~, <br />~~ <br /> <br />, <br /> <br />ORDINANCE NO. -5..8..6.. <br /> <br />An Ordinance Amending Section 26-24 of the City Code and <br />Section 4-230 of the Zoning Ordinance Regarding Division <br />of Property Occupied by a Two Family Dwelling <br /> <br />~ <br /> <br />The City Council of the City of New Brighton ordains as follows: <br /> <br />Section 1. Section 26-24 of the City Code and Section 4-230 of the Zoning Ordinance <br />are amended by adding the underlined material and by deleting the stl"ieken material <br />as follows: <br /> <br />Sec. 26-24. Minor subdivisions. <br /> <br />~ In the case of a subdivision of small size and of minor importance, <br />situated in a locality where conditions are well defined, the council may <br />exempt the subdivider from complying with some of the requirements of <br />this chapter; except that all applications other than those described in <br />paragraph (c) of this Section shall require a public hearing following <br />publication as prescribed in section 26-7 (f)+ and ~ mailed notification <br />to abutting property owners.=.. GOOll Be Rstifisa by mail. <br /> <br />ill In the case of a request to divide a lot which is a part of a recorded plat <br />where the subdivision is to permit the adding of a parcel of land to an <br />abutting lot or to create two (2) lots and the newly created property <br />line will not cause the other remaining portion of the lot to be in <br />violation with this chapter or the zoning ordinance, the division may be <br />approved by the council after submission of a survey by a registered <br />land surveyor showing the original lot and the proposed division. <br /> <br />1!:l In the case of a request to divide a lot containing an existing two family <br />dwelling to allow separate ownership of each unit, the city manager or <br />the manager's designee may approve such application if all of the <br />following conditions are met: <br /> <br />ill The applicant must submit a survey by a ree,:istered land <br />surveyor showing the orie,:inallot, the proposed division and the <br />location of all buildings on the lot. <br /> <br />ill The orie,:inallot shall have the required minimum lot dimensions <br />of 85 feet wide at building setback line and 12,500 square feet in <br />area. <br /> <br />ill. The property and structure must be able to be split into two lots <br />which are substantially equal in size and regular in shape and <br />topography. <br /> <br />ill The lot division does not create a new building site. <br /> <br />ill The structure must meet current Minnesota State Building Code <br />standards including but not limited to unit ' separation <br />requirements. <br /> <br />RHB39814 <br />NE136-8 <br />
