<br />Tlle City Council ot the City 01 N_ Brighton ordains
<br />.. follows:
<br />Section 1. Background.
<br />1.01. Several projlEIl1les In the City have been Includ-
<br />ed, by reaoon 01 the pr""'l"Ce thereon elf huardous
<br />eub8tanCeS, poIlutan1S or Contaminants. on the federal
<br />NttJon8l Prlorlt18ll List by the U,S, Environmental Pro-
<br />tection Agency (EPA), pursuant to the federal Com-
<br />p.........1v8 Environmental R8Ilponse, Compensation,
<br />and Liability Act 01 1980 (CERCLA), 42 U.S.C. fifi
<br />9801.9675, and On the, Minnesota'PermenentList of
<br />Priorities by the Minnesota Pollution Control Agency
<br />(MPCA) pllnlllant to, the Minnesota Environmental
<br />RHpoIl88 and Liability Act (MERLA), Minn. Slat. H

<br />1.02. n-e, properties (which are collectively
<br />hereinafter referred to as the "Subj8Cl Property") are
<br />kIgaIly described as follOWll:

<br />Gibbs, 440 . 5th Avenue NW, Said properties are
<br />generally bounded by 1st Street NW to the south, ,6th
<br />Street NW to the north, 5th Avenue NW to the east,
<br />and Old Hlghwey 6 or 6th Ayenue NW to the wes" (S\le

<br />1.03, The Subject Property has been determlnlld to
<br />be conteminated with e number of. pollutants end con-
<br />temlnants In(:ludlng:pentachlorophflnol (PCP):
<br />c/lrOnlated copper arsenate (CCA); polycyclic aromatic .
<br />hydrocatbons (PAHs);,polythlorlnated, ,dlbenzodloxons
<br />and polychlorinated dlbenso furans (!>COOs arid
<br />PCDFs).
<br />1.04, ThesepollutanlS and contaminants raprll8enl
<br />a potential threet to the public health due to release
<br />or thrHtened reIea8e to the environment and may also
<br />reprf88I1t ,a hazard to employees and others working
<br />on the Suoject Property.

<br />a study can be conducted and any modlfication.to the
<br />City's zoning. land use or building regulations are
<br />adopted. The Council has concluded that the SUbject
<br />Property should be Included In the area affectad by
<br />such an interim ordinance bee...... ute and federal

<br />1.07. Tlle Counci,l has directed that a etudy of Ihe
<br />adequacy of the current code as It epplill8 to such cOn,
<br />laminated sites be undertaken by the City's approptlate
<br />Boards, Commissions, Staff and/or consultants.
<br />1..08. Mlnneaote Statute. Section 462,355, Subd.
<br />4 (the" Act") pennllS the adoption of Interim ordinances
<br />during the planning process; and this ordinance Is
<br />adopted pursuant thereto.
<br />Section 2. Determination,
<br />2.01, During the period that thiS interim Ordlnence
<br />is in effect, no part of Ihe Subject Properly may be
<br />developed or redeveloped, nor sh8l1 any site plan ap-
<br />provals, rezonings. licen.... (other then renew~s), pial.
<br />tings or replattings, land dIVisions or conaolldatlOns,
<br />special use permits, grading permits or building piJr.

<br />2,03. This ordinance shall nlmain in effect for a period
<br />ot twelve months from its effective date or such eerller
<br />date lIS may be adopted by the City Council, provided
