<br />--' <br /> <br />Section 4. Section 4-109 is amended by adding new subparagraph (d) as <br />follows: <br /> <br />Sec. 4 -1 09 . Places ineligible. <br /> <br />ill No off-sale license shall be e;ranted for any premises which is within one <br />mile of another off-sale licensed premises in the City. <br /> <br />Section 5. New Section 4-113 is added as follows: <br /> <br />~ <br /> <br />'~ <br /> <br />Sec. 4-113. Abandonment. <br /> <br />Any license issued under this Division which is not used for a period of one <br />year at any time after the date of its initial approval by the City Council shall be <br />deemed abandoned and shall automatically terminate. <br /> <br />Section 6. New Section 4-133 is added as follows: <br /> <br />Sec. 4-133. Temporary On-Sale Licenses. <br /> <br />Bona fide clubs, charitable, religious, or other qualified nonprofit <br />organizations in existence for at least three (3) years may be issued a temporary on- <br />sale intoxicating liquor license for up to three (3) consecutive days upon meeting the <br />following requirements: <br /> <br />ill The organization, or a chartered chapter of the organization must have <br />had a substantial presence in the City for at least three (3) years; such <br />presence may be established by: <br /> <br />1!l <br />ill <br />ltl <br />ill <br /> <br />~ <br /> <br />having a corporate address in the City; <br />having ownership of a building in the City for the conduct of its <br />business and activities; <br />having a service area with the same boundaries as the City or as <br />any public school districts lying wholly or partly within the City; <br />being a school with residents of the City comprising ten percent <br />(10%) or more of its students or other organization with residents <br />of the City comprising ten percent (10%) or more of its members; <br />or <br />afinding by the City Council that other similar factors establish <br />a substantial presence in the City. <br /> <br />ill Completing an application as required by the City and by the <br />Commissioner of Public Safety. <br /> <br />ill Meeting all the requirements of laws and ordinances governing the sale <br />of intoxicating liquor except section 340A.49 and those laws and <br />ordinances which by their nature are not applicable. <br /> <br />ill Upon payment of a license fee determined by Council resolution unless <br />waived by Council. <br /> <br />ill Upon providing for adequate policing for the event and providing to the <br />satisfaction of Council that such policing will be provided. <br /> <br />CLL27837 <br />NE136-25 3 <br />
