Section 7-73 Intent It is not the intent of this article to discourage the design of future subdivisions to tak advantage of new ideas nor is it the purpose to prevent the placing of building corners in their relation~hip,with property lines in any o the r man n e r t h ant hat w h i c h . i ssp e ci fica 11 y s tat e d t h ere in. The city council shall permit the development of any area in such a way as to comply with any agreements made ,between the governing body 'and the developer at the time 'thij;,t a new plat is approved and recorded. Section 7-74 Variance Upon application by a property owner, the city council may vary any provision of this article in harmony with its general purpose and intent, where there are practical difficulties or peculiar hardships in the way of carrying out the strict letter of the provisions of this section so that the public health, safety, and general welfare may be secured and substantial justice done. The procedure to be used for the processing of such variance applications shall be the same as provided for in the zoning code. Section 7-75 Street Access Each applicant for a building permit must satisfy the administrative authority that the property to be occupied by said building shall have access to a public street or way, or taa private way protected by a permanent easement which shall be of width and construction suitable to traffic requirements of the neighborhood in which the property is located. This shall not be construed to include alleys or service ways. Where a private easement is to be used, it shall require special permission by the city council. Section 7-76 Utilities And Street Required No building permit shall be issued for any new construction unless and until all underground utilities are installed in the public street adjacent to the parcel of land to be improved and the rough grading of the adjacent street has been completed to the extent that, in the opinion of the city engineer, adequate street access to the parcel is available. Section 7-77 Trailer Prohibitions The removal of wheels from any trailer, or the remodeling of a trailer through the construction of a foundation or the enclosure of the space between the base of the trailer and the ground, or through the construction of additions to provide extra floor space will not be considered as conforming with the city's building code in any respect and will, therefore be prohibited.
