. ~e,l :Ala ... e e e T ORDINANCE NO. 500 ORDINANCE: SlMo1ARY , Final Franchise North Suburban Cable COIlmunications CCmnission An ordinance, including addendum with exhibits, granting a franchise to Group W Cable of the Noeth Suburbs, Inc., a Minnesota oorporation (hereinafter "Group WIt) to operate and maintain a cable ccmnunications system in the city of New Briqhton setting forth oonditions acccmpanying the grant of franchise; providing for regulation and use of the system; and prescribing penalties foe the violation of its provisions. STATEMENT OF mI'ENT AND PURPOOE; FINDINGS. The city of New Brighton (hereinafter "City") adopts a cable television franchise to bring about: the developnent of a cable television system and the continued operation of it to better facilitate the oammunications needs of residents of the City and to better utilize and' improve public ser- vices. The City Council found Group W's technical ability, financial COndition, legal qualifications, and character to bE~ appropriate to oonstruct and operate a cable television system within City. ARl'ICLE I. SHORI' TI'l;'LE AND DEFINITICNS The Ordinance shall be known and cited as the Cable Comnunications Ordinance. The definition section includes 23 terms which are defined for the purpose of the franchise. ARrICLE II. GRAN!' OF AUI'HORITY AND GENERAL PIOJISIONS socrIcN 1. GIWlr CF FlWOJISE AND ACCEPI'J~ The City grants to Group W Cable a non-exclusive franchise to be pro- perly executed and acknowledged by Group, W and delivered to City. Group W shall deposit with City a non-refnndable acceptance fee for the purpose of deferring the c::osts and expenses of develcpnent of the franchise. Security deposits, let- ters of credit, certificates of insurancEl, bonds, and organizational and creation documents of the a:mpany must be~ delivered to City. SBCl'ICN 2.. AUl'HORI'IY GRANlED The City grants to Group W permission to use the streets for erecting, constructing, operating and maintaining the cable ccmnWlications system. SIlCI'ICN J. ~ Group W agrees to be bound by a.U terms of the franchise and to pro- vide all services set forth in its proposal to City.
