OHDINANCE NO. ,SOl STATE OF MINNESOTA COUNTY OF ~.r,'ISEY CITY OF NEW BRIGHTON AN ORDINANCE AMENDING ARTICLE V, CHAPTER 5 OF THE NEW BRIGHTON CITY CODE The Council of the City of New Brighton does hereby ordain as follows: Section 1. Chapter 5 of the New Brighton City Code is hereby amended by adding Article V governing licensing and regulating of gambling as approved by the State Legislature and is read as follows: Sec. 5-130. PROVISIONS OF STATE LAW ADOPTED. The provision of Minnesota Statutues, Chapter 349, and Laws of Minnesota, 1978, Chapter 507 as amended, relating to the definition of terms, licensing and restrictions of gambling are adopted and made a part of this Ordinance as if set out in full. Sec. 5-131. LICENSING REQUIREMENTS. No person shall direct y or indirectly operate a gambling device or conduct a raffle with- out a license to do so as provided in this Ordinance. Sec. 5-132. PERSONS ELIGIBLE FOR A LICENSE. A license shal be issued only to fraternal, religious, and veteran's organizatio s, or any corporation, trust, or association organized for exclusive y scientific, literary, charitable, educational or artistic purpose or any club which is organized and operated exclusively for pleasure or recreation as distin~ from profit making purposes. Such organization will have been in existence in the City of New Brighton for at least three (3) years and shall have at least thirty (30) active Bembers. Sec. 5-133. LICENSES AND FEES. Subdivision 1. There are established two types of licenses for each device or occasion together with the respective fees as hereinafter set out: (a) The single occasion temporary license fee for all is $40 each for up to a consecutive three (3) day period. (b) The annual fee for a paddle wheel, tipboard, pull-tabls or ticket jars shall be $150 for first device type, $100 for second device type and $50 for each device type thereafter. (c) The annual fee for raffles by an organization shall be: $20 for prizes up to total value of $250; $50 for prizes up to total value of $1,000; $100 for prizes up to total value of $5,000; $150 for prizes up to total value of over $5,000. (d) The fees for devices used by non-profit, civi groups for special events may be waived upon finding that a major portion of revenues is to be used for a project or activity of direct benefit to the general public, as det- ermined by the City Council.
