<br />OHDINANCE NO. ,SOl <br /> <br />STATE OF MINNESOTA <br />COUNTY OF ~.r,'ISEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING ARTICLE V, CHAPTER 5 OF THE NEW BRIGHTON <br />CITY CODE <br /> <br />The Council of the City of New Brighton does hereby ordain <br />as follows: <br /> <br />Section 1. Chapter 5 of the New Brighton City Code is <br />hereby amended by adding Article V governing licensing and <br />regulating of gambling as approved by the State Legislature <br />and is read as follows: <br /> <br />Sec. 5-130. PROVISIONS OF STATE LAW ADOPTED. The provision <br />of Minnesota Statutues, Chapter 349, and Laws of Minnesota, 1978, <br />Chapter 507 as amended, relating to the definition of terms, <br />licensing and restrictions of gambling are adopted and made a <br />part of this Ordinance as if set out in full. <br /> <br />Sec. 5-131. LICENSING REQUIREMENTS. No person shall direct y <br />or indirectly operate a gambling device or conduct a raffle with- <br />out a license to do so as provided in this Ordinance. <br /> <br />Sec. 5-132. PERSONS ELIGIBLE FOR A LICENSE. A license shal <br />be issued only to fraternal, religious, and veteran's organizatio s, <br />or any corporation, trust, or association organized for exclusive y <br />scientific, literary, charitable, educational or artistic purpose <br />or any club which is organized and operated exclusively for <br />pleasure or recreation as distin~ from profit making purposes. <br />Such organization will have been in existence in the City of New <br />Brighton for at least three (3) years and shall have at least <br />thirty (30) active Bembers. <br /> <br />Sec. 5-133. LICENSES AND FEES. <br /> <br />Subdivision 1. There are established two types of <br />licenses for each device or occasion together with the respective <br />fees as hereinafter set out: <br /> <br />(a) The single occasion temporary license fee <br />for all is $40 each for up to a consecutive <br />three (3) day period. <br /> <br />(b) The annual fee for a paddle wheel, tipboard, <br />pull-tabls or ticket jars shall be $150 for <br />first device type, $100 for second device <br />type and $50 for each device type thereafter. <br /> <br />(c) The annual fee for raffles by an organization <br />shall be: <br />$20 for prizes up to total value of $250; <br />$50 for prizes up to total value of $1,000; <br />$100 for prizes up to total value of $5,000; <br />$150 for prizes up to total value of over <br />$5,000. <br /> <br />(d) The fees for devices used by non-profit, civi <br />groups for special events may be waived upon <br />finding that a major portion of revenues is <br />to be used for a project or activity of <br />direct benefit to the general public, as det- <br />ermined by the City Council. <br />
