<br />1'4 -'" <br /> <br />ORDINANCE NO 520, <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING SECTION 4-600 OF THE NEW BRIGHTON ZONING CODE PERTAINING <br />TO DISH ANTENNAS ' <br /> <br />'.~' ~ -'.' <br /> <br />The New Brighton City Council does ordain: <br /> <br />SECTION I. That Section 4-600(a). Height exceptions, is hereby <br />amended to read as follows: <br /> <br />a. Height limitations shall not apply to the following: <br />1. Church spires, belfries, cupolas and domes; <br />2. Chimneys and smokestakes; <br />3. Flag Poles; <br />4. Any antenna or combination of antenna and tower rigidly <br />attached to a building provided that the combination of <br />antenna and tower does not exceed a total height of 20 <br />feet above the highest point of attachment. <br />5. Any dish antenna thirty (30) inches or less in diameter. <br />6. Roof-mounted mechanical equipment shall be either . <br />screened or completely enclosed and shall be excepted <br />from the height limitations if the enclosure(s) does <br />not occupy more than thirty (30) percent of the roof <br />area and does not extend more than 12 feet above the <br />roof upon which it is located. <br /> <br /> <br />SECTION II. That Section 4-600(c) and (d), Height Exceptions, is hereby <br />amended to read as follows: <br /> <br />c. No exterior dish antenna having a diameter in excess of <br />thirty (30) inches shall be allowed in an R-l or R-2 <br />zoning district unless it complies with the following <br />requirements: <br />1. Dish antennas shall not be located on the roof of any <br />structure. <br />2. Ground mounted dish antennas shall only be located in <br />a rear yard and shall not be located within five (5) <br />feet of any side lot line and five (5) feet of any <br />rear lot line. <br />3. Ground mounted dish antennas shall not be located <br />within ten (10) feet of any principle structure. <br />4. Ground mounted dish antennas shall be located at least <br />twenty-five (25) feet from any adjacent residential <br />structure. <br />5. Ground mounted dish antennas shall be screened from <br />adjacent residential properties. Screening techniques <br />shall be such that screening is effective throughout <br />all seasons of the year. <br />d. Special use permit. Any structure, other than as noted in <br />Section 4-600 a. that is proposed to exceed the height <br />limits imposed by this Section may be permitted by a <br />special use permit. A special use permit shall be con- <br />sidered provided it is determined that the location and <br />size of the use and type of operation involved therein, <br />shall not be injurious to the public health, safety, <br />convenience or general welfare, and shall not injure or <br />adversely affect the adjacent area of property values. <br /> <br />The Planning Commission, in making a recommendation, and <br />the Council, in acting upon the special use permit, shall <br />consider the following factors: <br />1. The application for special use permit shall be pro- <br />cessed according to Chapter VIII of the zoning code. <br />2. Applications for special use permits must meet the <br />standards of Section 4-600 b.l. through 9. except for <br />guyed structures must contain engineering information <br />on collapse radius and the setbacks shall be equal <br />to or greater than seventy-five (75) percent of the <br />height of the proposed antenna. <br /> <br />Adoptedt~'i.s27th day of Marcb , 1984. <br /> <br />((A 2//' <br />J1:~ n;e.
