That Ordinance No. 500, Article VI, Section is <br />hereby amended to read as follows: <br /> <br />AmEtldment by Substitution to Article VI (Passive Rate Review): <br /> <br />SECf,ION 4. FRANanSE FEE, RATES, CHARGES, CHANGES TN FEES AND PROCEOORES <br />A. Rate ~e Procedure. <br />(1) To the extent permitted by law, all increases in subscriber rates <br />and charges shall be charged by Grantee in a marmer provided for <br /> <br />herein. Grantee, as a condition precedent to its acceptance of <br /> <br />this Franchise hereby knowingly and voluntarily consents to these <br /> <br />.. <br /> <br />procedures for the term of this Franchise of all rates and <br />charges. <br /> <br />(2) City hereby reserves the right to approve or adopt regulations <br /> <br />~ \ <br /> <br />governing Grantee's collection of advance charges and deposits; <br />installation and reconnection charges. policies and procedures; <br />discormection charges. policies and procedures; and fXJlicies <br />regarding and the availability of refLmds. Approval of City shall <br />not ,be unreasonably withheld or delayed. <br />(3) Cost for installing any part of the System will be a factor in the <br /> <br />rate only if such cost was incurred within the rate territory. <br /> <br />(4) The territorv for rates applicable to System shall be City and all <br /> <br />Cities ~ich have granted a Franchise to Grantee relative to the <br /> <br />System delineated in the Offering. <br /> <br />B. Franchise Fee. <br /> <br />(1) Throughout: the term of this Franchise, Grantee shall pay to City, <br />wi thin 60 days after the end of each fiscal year of Grantee. an <br />annual Franchise fee of five percent (5%) of all Gross Revenues. <br />No payment will be all~ of any Franchise fee that is differQI'lt <br />tran five percent (5%). other than the filing fee and payment <br />required of the successful applicant as established by City to <br />
