A new Section 4-9 is"hereby'added to.the City <br />Code to read as follows: <br /> <br />(a) No license nor any special use permit required by this <br />Chapter shall be granted to premises with a property lin <br />within 400 feet of the piopdrty line of any public or <br />parochial school or church in the City. The Council, <br />its sole discretion, may allow a lesser distance upon <br />making a finding that the location of said license is <br />unduly detrimental to the public health, welfare and <br />safety of the citizens of New Brighton. The Council, at <br />its sole discretion, may require a greater distance upon <br />making a finding that the location of said license is <br />unduly detrimental to the public health, welfare and <br />safety of the citizens of New Brighton. Such findings <br />shall be made by the Council after considering the effec <br />of natural barriers, highway thoroughfares, proximity to <br />park areas and other areas of public assembly, the <br />activities conducted in any such church or school, the <br />nature of the licensed operation and the orientation of <br />and access to the building and property. <br /> <br /> <br />Sec. 4~9. PLACES INELIGIBLE. <br /> <br />Section 2. The following Sections of Chapter 4 are hereby <br />repealed: Section 4-l6l(c), Section 4-109(d) and Section 4-73(a). <br /> <br />Section 3.
