II AND XI OF THE NEW BRIGHTON~ .~ <br />ZONlNG CODE IN REGARD TO HOUSlNG FOR THE ELDERLY <br />! <br />I <br /> <br />.~, <br /> <br />The Council of the City of New Brighton hereby <br />ordains: <br /> <br />Section 1. Chapter II of the New Brighton Zoning Code <br />is hereby amended by adding thereto Sections 2-750 and 2-760 <br />which read as follows: <br /> <br />Section 2-750, Person, Elderly <br /> <br />A person, married or single, sixty-two (62) years <br />of age or more. <br /> <br />Section 2-760, Housing, Subsidized <br />A residential building which receives financial <br />assistance from Federal, State or Local government <br />agencies for the pur.pose of reducing rents to a <br />level of affordable by' persons of low-income as <br />defined by the U.S. Department of Housing and Urban <br />Development. <br /> <br />Section 2. Section ll-350(g) of the New Brighton Zoning <br />Code is hereby amended by adding thereto a sub-section 4, <br />which shall read as folLows: <br /> <br />4. In order to provide for the unique characteristics <br />of developments serving the low-income elderly and <br />in recognition of their reduced levels of population <br />and activity, subsidized housing developments for <br />elderly persons may have theirdenisty calculated on <br />the basis of fifty percent (50%) of the minimum lot <br />area per dwelling unit stipulated for the respective <br />districts in this zoning ordinance. <br /> <br />I. <br />II <br />I' <br />I <br /> <br />Notwithstanding any other provision of this ordinance <br />to the contrary, this paragraph shall apply to <br />planned housing developments for the elderly for whic <br />on application has beentecelved ahd upon which actio <br />by the City Council is still pending at the time of <br />adoption of this ordinance. <br /> <br /> <br />Section 3.
