""'-. )" '~,t ,r it ~" ~ ~"'" ~" ," " 'i ORDINANCE NO. 417 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON '..... .......~~ ~ ORDINANCE AMENDING CHAPTERS 3 AND 10 OF THE NEW BRIGHTON ZONING CODE IN REGARD TO THE USE OF BUILDING pERMITS AND RELATED AUTHORIZATIONS. The Council of the city of New Brighton does hereby ordain: Section I. Section 3-60 is hereby amended by adding thereto a paragraph f. which shall read as follows: f. A non-conforming use permit, when not used, shall expire after one hundred eighty (180) days after date of authorization unless written application for renewal or time extension is received and granted by the City Council prior to the expiration date. Section II. Chapter 10 is hereby amended by adding thereto a section 10-180 which shall read as follows: Section 10-180 Time Limit. a. A building permit authorized by the City Council for the construction or enlargement of a structure other than a single or double family residence, when not used, shall expire after one hundred eighty (180) days after date of City Council authorization as required by Section 10-170 unless written application for renewal or time extension is received and granted by the City Council prior to the expiration date. b. For purposes of this ordinance a building permit authorization is considered used when the building permit has been issued by the building inspector. II II c. All building permits authorized by the City Council prior to the enactment of this ordinance but not yet used are hereby made subject to the provisions of paragraph a. above except that their authorization date(s) is deemed to be the date of adoption of this ordinance.
