Any person <br />r harbors a cat declared to be a nuisance hereunder shall <br />o be maintaining a nuisance. <br /> <br />who owns <br />be deeme <br /> <br /> <br />Section 635:10 citations, Impoundinq. In the event any cat <br />s found at large in the Village of New Brighton by the New Brighto <br />olice or Animal Control Agent and the owner is known or can be <br />scertained from available information, a citation for such <br />iolation shall be issued to the owner of such cat. If the owner be <br />nknownthen such cat shall be impounded. <br /> <br />Sect~on 635:12. Redemption. Any cat impounded under 635:10 <br />ay b e redQem~d from the pound by the owner or keeper within five <br />(5) days by the payment of an impounding fee of $5.00 and $2.00 <br />day the cat is confined in the pound as the cost of <br /> <br />Section. 635:14. Release. Upon tbe;presentatio~ Of proof of <br />ayment of the fees provided in Section 635:12,thepouridmaster <br />hall release to any owner the cat claime~ by him. The poundmaster <br />hall further take the necessary steps to cause the (Mner of the <br />at to be charged with any violation of Section 635 of the New <br />righton Village Code which gave rise to the impounding of the <br />nimal. <br /> <br />Section 635:16. Disposition of Unclaime.dCats. Any cat <br />hich is not claimed as provided in Sectit;m635: 14, within five (5) <br />ays after impounding, not including Sunday or hOlidays, may be <br />old for not less than the amount provided in Section 635:14 to <br />nyone desiring to purchase the cat, if not requested by a licensed <br />ducationalorscientific institution und~r Minnesota Statut.es <br />5.71. All sums received above the costs and tax Shall be placed <br />y the C~erk in the general fund of the Village. Any cat which is <br />ot claimed by the owner or sold shall be disposed of. <br /> <br />Section 635.18. Establishment of Pound. A village pound is <br />ereby established for the purpose of placeing this ordinance in <br />ffect which shall be at such location, either within or without <br />Village, as the council by resolution shall designate. <br /> <br />Section 635:20. Interference with Qfficers. It shall be <br />nlaw fill for any unautbprized person to break open the,::pmund <br />r to attempt to do so, or totake or let out any cats therefrom, <br />r to take or attempt to take from any officer any cat taken by <br />im in compliance with this ordinance or in any manner to interfere <br />ith or hinder suc:h officer in the discla rge of his' 4uties under <br />his ordinance. <br /> <br />Section 635: 22. Violations, Penalty. Any person found <br />uilty of maintaining a nuisance under Section 635:08 or ofviolati g <br />he provisions of Section 635 shall be guilty of a misdemeanor. <br />'II e minimum fine for the first offense smll be $15..00. The <br />I,: inimum fine for any subsequent offense shall be $50.00. <br />
