<br />THE 19UCODE OF ORDINANCE REkATlNG TO THE
<br />COLLECTION OF GARBAGE IN THE VlkkAGE OF
<br />NEW BRIGHTON
<br />The village Council of the Village Of New Brighton
<br />does hereby ordain:
<br />SECT ION 1, Section 840 Of the 1966 Code of Ordinllflce
<br />is hereby amended to read as follows:
<br />Section 840:00 Definitions. Whenever used In this
<br />ordinance, words shall have the following meanings:
<br />SUbd, 1, Approved shall mean acceptable to the
<br />Health Authority following his determination as to
<br />compliance with established public health pra<:tlces,
<br />Subd, 2, Health Authority shall mean the municipal
<br />Public Health S"nitarian or his authori%erJ represen. ,
<br />talive,
<br />Subd, 3, Persons(s) shall mean any owner, trustee, or
<br />occupant 01 "ny premise, or the owner, manager,l)I'
<br />proprietor whO, alone, jointly or severally with others
<br />shall be in ownerShip of, or have charge, care or control
<br />ot. any premise,
<br />Subd, 4, Premise is any single or multiple residential
<br />dwelling, mobile hOme, commercial or industrllll
<br />building, club, church, SChool, or other strU<:lure in.
<br />cluding all the lands thereof, and "ny and all parcels of
<br />,,,nd void of structures of any kind,
<br />Subd, 5, Public Place is any and all streets, sidewalks,
<br />bOulevards, alleys. parkS, pUbliC buildings, and othe
<br />publiC ways,
<br />.subd, 6. Garbage Includes all putrescible organic
<br />waste materials, including the cans, containers or
<br />wrappers wasted along wlth such materials. Garbage, \
<br />under thiS dellnition, is understood to include such
<br />dQmestic and,or commercial waste products as: animal
<br />excreta or carcasses "nd residues Obtained in the
<br />prOCeSSing.. preparation. consumption. display, Sa14l'. 01'
<br />storage of meat, fish. fowl, fruit, vegetables, grain, \ltc.
<br />Subd. 1. Rubbish includes all non-putrescible welle
<br />materialS from dQmestic, commercial, or Industrial
<br />sources. Rubbish, under this definiflon, is understOOd to;
<br />Include such wastes as: grass clippings, leaves, wood,
<br />wooden waste. paper, rags, shoes, clothing, sweepings,
<br />cleanlngs, cans, containers, junk vehictes, ashes, tires,
<br />etc., and other matter resulting from the demoiltiQn,
<br />alteraflon, or construction Of buildings Or structures, or
<br />any other such substances which may become a
<br />nuisance-
<br />Subel. 8. Owner Is a person, firm, corporation, or other
<br />partnerShiP or Organization WhO alone, jointlY, Or
<br />severally with others shall be In ownership of, or have
<br />charge, care or control of, any premises or bUSiness
<br />with the municipality as owner. employee or aoent,.Of
<br />fhe owner.' or ,IS trustee or guardian of the estate Or -
<br />porson of the title hOlder. '

<br />Every person, of any premise Shall dlSpOlle Ofgat'bege

<br />compliance date, the provider or user Of the detective

<br />sublect to the penalties contained herein.
<br />Seetlon lMO: 10 LIcensing and Duties of Collector.

<br />Subel. .2, .Appllcafion.
<br />Any person, f'irm, or corporation desiring a license to
<br />collect garbage or rubbish shall make application for
<br />the same to lhe Village Clerk upon a form prescrlbl!d to
<br />the Village Council. The application shall set forth: (1)

<br />Section 840: 15 Separability.
<br />If any section, subsection, group. phrltse, sentence, or
<br />)(tlon of this ordinance is for lIny reason held invlllld
<br />. unconstitutional, such portions shall be deemed a
<br />eparate distinct and Independent provision and SUCh
<br />",Iding shall not affect the validity Of the remaining
<br />"'rtions hereof.
<br />Section 840:20 Penalty
<br />Any person violating any of the provisions of this
<br />ordinance, shall. upon conviction, be guilty. of a
<br />misdemeanor, and sublecf to a fine Of not exceeding
<br />$300 and Imprisonment for a period Of not excee<llng 90
<br />days,
<br />Section 840: 25 Complillnce
<br />All existing premises Which generate garbage and""r
<br />rubbish for subsequent collection shall comply with the
<br />provisions of thiS ordinance within 90 days of the ef-
<br />fective date of this ordinance.
<br />Section 840:30 Effective Date
<br />The effective date of this ordinance shall be May 18,
<br />1972.
