<br />N ORDINANCE AMENDING SEWER DEPARTMENT REGULATIONS, BY AMENDING
<br />ECTION 265:02, SUBD.. 4, OF THE Nll::W B~IGHTONVILLAGE CODE BY
<br />ROVIDING FOR WAIVERS TO SEwER CONNECTION
<br />
<br />The Village council of the Village of NElw Brighton does
<br />ordain:
<br />
<br />SECTJ:ON 1. Sec1;ion 265:02, Subdivision 4 of the 1966
<br />Ordinance Code of th~Yillage of New Brightoo'; l:>eing a part of
<br />Sewer Department Reg"1tations, is hereby amended to read as
<br />follows:
<br />
<br />Subd. 4. (a) TheDWner of every house, building ,qrproperty
<br />used for human occupancy, employment, recreation or othe,r purposes
<br />which is situated within the Village and which abuts upon any
<br />street, alley, or right-of-way in which there is now or hereafter
<br />located a public sewer available for interconnection to such
<br />property is required at such owner's expense to install suitable
<br />toilet facilities therein~ and to connect such facilities. directly
<br />to such public sewer and in accordance with the provisions of this
<br />ordinance on or before July 1, 1970. No such connect.ion shall be
<br />required, however, unless such public sewer is located and
<br />available for connection within seventy-five (75) feet of the
<br />property line of the premises concerned and hasbeen,sQlocated
<br />and available for at least six (6) months.

<br />(b) In the ,event that compliance with Section 265:02, Subd.4
<br />(a) creates a hardship to the owner-occupant of the property by
<br />reascmof inability to payor to an owner by reason of the value,
<br />condition or other factors relating to the property its~lf, the
<br />Village Council may, upon written application fromthem.mer,
<br />waive.the requirelUents of Section 265:02 Subd. 4 (a). Suchwaiver
<br />may be, granted to the owneronly;:,if the Village Council finds that
<br />the private sanitary sewer system is adequate to meet health and
<br />safety standards. The waiver may be for a period n9t to exceed
<br />one (Ir. year~. Upon receipt of such an application, the
<br />IJirector of Public Works shall inspect the property and report
<br />his findings.in writing. Such waiver shall not he transferable
<br />and automatically te~ina'tesu~n a''''chaI:1ge of ownership of the
<br />subject property.. , . .' . .
