<br />AN ORDINANCE AMENDING SECTION 240 OF THE
<br />1966 ORDINANCE CODE OF THE VillAGE OF NEW
<br />BRIGHTON ENTITLED "PERSONNEL POLICY"
<br />The New Brighton Village Council does hereoy or,
<br />dain:
<br />SECTION 1. The 1966 Ordinance Code of the Village of
<br />New Brighton Section 240;30 is hereby amended to
<br />read"
<br />Section 240,30 Sick leave
<br />SUl>d. 1. Eligibilitv, Sick leave with pay sh..1I be
<br />granted 10 all probationary ..nd permanent employees
<br />at the r..te of one working day for each calendar month
<br />of full,time service or major fraction thereof. except
<br />that sick leave granted probation..ry employees shall
<br />not be availaole for use until satisfactory completion Of
<br />the initial probalionllrY period, Promotional
<br />probationary employees Ill"y make use Of sick leave;
<br />hOwever, if the sick leave exceeds a total of five (5)
<br />working days, the probationary period shall
<br />automatically oe extended.. like period of time,
<br />Subd. 2. Accrual and Use, Sick leave may be ac,
<br />cumulated to a maximum of 120 days. Sick leave may be
<br />granted only for ..bsence from duty because of personal
<br />illness, disability occurring off-duty, legal quarantine,
<br />or dei3th or serious i1lnes5, in the immediate family. The
<br />immedi..te family is defined as the following kin of
<br />either the employee or the employee's spouse: Children,
<br />mother. fatherl sister. brother, or grandparents.
<br />Procedures' for disability occurring on-duty are
<br />governed by the provisions of Section 240:31. "Injured
<br />on Duty,"
<br />Subd. 3. proof Required, In order to be eligible for
<br />sick le~ve with pay, ~n employee must;
<br />1. Report promptly to his dep~rtrnent head the reason
<br />for his absence.
<br />2. Keep his department he~d informed of his con,
<br />dilion, if the absence Is more tMn three (3) days
<br />dur~tion,
<br />3. Submit a medical certificate for any absence ex.
<br />ceeding three (31 days if required by the Village
<br />Man~ger ,
<br />Subd. 4. Pen~ity, CI~imlng sick leave when physically
<br />fit. .except ~s permilled in this section may be cause for
<br />disciplinary action. including traosfer, suspension,
<br />demotion or dismissal.
<br />SUbd. S. Terminal Sick Leave. Terminal sick leave
<br />shall be granted in the amount of twenty (201 percent of
<br />~ccrued sick leave to employees who have completed
<br />te-n (10) years of service.
<br />Subd..6, "Bank" Sick LeaVe, Employees who have
<br />accumulated the maximum of 120 days sick leave shall
<br />be permitted to accrue additional ,jbank'i sick leave at
<br />the rete of one day per month, I'Bank" sick leave may
<br />be used onlv after reqular sick leave h~S been exhausted
<br />~nd only for personal illness or dist;lbility. IIBank" !iic:k

<br />SECTION 2, The 1966 Ordinance Code of the Village of
<br />New Brighton is further amended by adding Sedion
<br />240:31, "Inlured on Duty" which shall read as follows;
<br />Section 240:31 Injured on' Duty
<br />a. Words, terms, and phrases. Unless the language.or
<br />context clearly indicetes th..t a different meaning is
<br />intended, the follOWing words, terms and phrases, for
<br />the purposes of thiS section, sh~1I be given fhe meanings
<br />suo joined to them, .
<br />b, Vill~ge SMre. "Village' sh..re" shall mean the
<br />difference between full salary and workmens com-
<br />pensation.
<br />c. Sick Leave use Percentage. "Sick leiC.'ve use per-
<br />centa\;)e" shall mean the "Village Share" divided Oy full
<br />salary each computed from equivalent time periOds,
<br />Subd. 2. Eligibility, Eligibility for injured on duty
<br />benefitS shall oe based on the injured employee'S
<br />qualification for workmenscompensation benefits, If an
<br />employee has oeen determined eligible for workmens
<br />compensati,on benefits. he is then also eligible for in,
<br />jured on duty benefits. I f an employee has been
<br />determined not ellglole for workmens compensation
<br />benefits, he Is also not eligible for inlured on duty
<br />benefits.
<br />Subd. 3. Injured on Duty Benems. Any employee
<br />found eligible for injured on duty benefits shall receive
<br />the fOllowing benefits; .
<br />a. The first five (5) working days of absence due to
<br />iniury on duty shall be deducted from an employees
<br />accrued sick leave, and the employee shall receive full
<br />salary,
<br />
<br />b. For each working day of absence due to injury on
<br />dutv afler the first five (5) working days, the employees \.,
<br />shall be compen5ated.. the "Village Share." Such
<br />compensation shall not be paid for more than sixty 11
<br />working days, During such period nO accrued sick leave
<br />shall be deducted.
<br />c. For each working day aller the tirst sixty,five (65) IE
<br />working days of absehce due to Injury on duty, the ~
<br />employee sha1\ receive the IIVillage ShQre" as sick 'C
<br />leave benefits and accrued sick leave shall be deducted ~,
<br />at the "sick leave use percentage." If the employee has ~
<br />no accrued sick leave remaining after sixty'five (65) h
<br />days of absence due to injury on duty, he shall receive
<br />no further compensation from the Village, during the .~
<br />dUfotion of such ob~ence. h
<br />Subd. 4. Eligibility Determined Valid After Five II
<br />Working Days of Aosence and Employee Has Accrued it
<br />Sick Leave Remaining, In those cases where eligibillfy :s
<br />lor workmens compensation heS not been determined s
<br />valid until afler five (5) working days of absence and f',C;'
<br />where such' employee has accrued sick leave
<br />remaining, the employee shall use accrued sick leave
<br />according to the proviSions of Section 240:30, unfll such
<br />time such employee Is determined eligible. When
<br />determined eligible injured on duty benefitS shall be
<br />calcuiated as follows:
<br />a, From the day that eligibility has been determined. 'I'

<br />b. For all working days after the first five (5) to the
<br />date of eligibility determination sick leave shall be
<br />reinstated in an amount equal to the sick leave use
<br />percentage multiplied by the number of sick leave days
<br />utif.ized afler the first five (5) days, In no case shall
<br />more sick leave time oe reinstated than sixty (60) days
<br />multiplied by the sick leave use percentage.
<br />Subd. S. Eligibility Determined Valid After Five
<br />working Days at Absence ,and Employee heS Depleted
<br />Sick Leave Prior to an Eligibility Determination. In
<br />those cases where eligibility for workmehs com-
<br />pensation has not been determined valid until after five
<br />(5) working davs of absence and where such employee
<br />has depleted all sick leave prior to an eligibility
<br />determination, an employee shall use accrued sick
<br />leave according to the provisions Of Section 240;30, until
<br />such time that all sitk leave is depleted and thereafter
<br />shall receive no further village oenefil until eligibility is
<br />determined valid. When determined eligible injured on
<br />duty benefits sM11 be calculated as follows:
<br />a. From the day that eligibility has been determined
<br />valid, injured on duty oenefits shall be in accordance
<br />with Section 240;31, Subd. 3, for the remainder 01 the
<br />sixty da,y coverage period.
<br />b, For all working days at absence after the first five
<br />(5) to the date of eligibility determination"sick leave
<br />shall be reinstated in an amount equal to the Sick leave
<br />use percentage multiplied by the number of sick lea;'e
<br />days utilized afler the first live (5) days. In no case shall
<br />more sick leave days oe reinstated than sixty (60) days
<br />mullipf.ied by the sick leave use percentage,
<br />c, The employee shall be further compensated in an
<br />amount equal to the number of sick leave days utilized
<br />~f1er the first five (5) working days of absence sub,
<br />tracted from .the numoer .of working days of absence
<br />after the first five (5) days to fhe date Of ef.igibllity
<br />determinafion, .that total multiplied by the village
<br />share.
<br />Subd. 6. Eligibilitv Determined Invalid. In cases
<br />where it is determined that an employee is ineligible for
<br />work menS compensation benefits, he sMII be sUbjed to
<br />the provisions of Section 240:30.
<br />Subd. 7. Vacation Option. When an employee's sick
<br />leave has been exhausted under the provisions of
<br />Section 240'31. he may exercise the option of converfing
<br />ac:;:c:;:rued vacation doYs to sick lei3ve days. In those cases
<br />where an emplOyee has exercised the above delineeted
<br />option, i;lnd i5 eligible for sick leave reinstatement, he
<br />may have vacation reinstated in an amount equal to the
<br />reinstatement total, out not to exceed the total vacation
<br />time converted.
<br />SECTION 3. Effective Date, ThiS ordinance shall be in
<br />full force and effect from and afler Its adoption by the
<br />Village Council and its publication, with provisions
<br />being retroactive to January 1, 1972,
