'..~ <br /> <br />ORDINANCE NO. <br /> <br />270 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />VILLAGE OF NEW BRIGHTON <br /> <br />AN ORDINANCE AMENDING SECTION 400 OF THE NEW BRIGHTON VILLAGE <br />CODE ENTITLED BUILDING CODE BY ADDING SECTION 400:02 ENTITLED <br />CERTIFICATES OF OCCUPANCY <br /> <br />The Village Council of the Village of New Brighton does <br />ordain: <br /> <br />SECTION 1. Section 400 of the New Brighton Village Code is, <br />hereby amended by adding thereto Section 400:02 as follows: <br /> <br />SECTION 400:02. certificates of Occupancy <br /> <br />Subd. 1. A temporary or final certificate of Occupancy <br />pursuant to Section 306 of the Uniform Building code shall not <br />be issued for any structure, except single family detached <br />I dwellings, unless and until all of the following requirements, in <br />addition to the requirements contained in Section 306 of the <br />Uniform Building Code, have been fulfilled: <br /> <br />(a) All permit fees due to the Village of New Brighton in <br />connection with the erection or alteration of the <br />structure have been paid. <br /> <br />(b) All charges due to the Village of New Brighton for <br />connection to Municipal Water and Sewer have been paid <br /> <br />. I <br /> <br />(0) All requirements for ,off-street parking as contained <br />in the New Br ighton 'i:Zoning Code have been fulfilled <br />and completed. <br /> <br />(d) All requirements for landsc aping of the premises as <br />contained in the New Brighton Zoning Code haVe been <br />fulfilled and completed. <br /> <br />Subd. 2. Exceptions. <br /> <br />I <br /> <br />(a) The Villagec.ouncil may permit a temporary certificate <br />of Occupancy to be issued without the requirement of <br />Section 400: 02 Subd. 1, Subs,~ction (c) having been <br />fulfilled in its entirety if the required area for <br />dff-sti~et parking 15 available and useable for parking <br />withoutpermanept surfacing having been completed. <br /> <br />(b) <br /> <br />The Village Council may permit a temporary Certificate <br />of Occupancy to be issued without the requirement of <br />Section 400:02, Subd. 1, Subsection (d) having been <br />fulfilled. Such permission may be granted Only upon <br />the developer filing an application for such permission. <br />The application shall be accompanied byafee of $50.00 <br />to defray administrative costs in considering the <br />application and shall set forth the reasons for the <br />request.
