It is hereby determined, pursuant to Minnesota <br />Pollution Control Agency regulations, that the Village of New <br />Brighton does have available an adequate and effective solid waste <br />and refuse collection service by means of private haulers. <br /> <br />SECTION 504:00 Outside Burning Prohibited. No person shall <br />burn grasslands, marshes, meadows, leaves, trees, brush, wood, <br />paper, garbage, refuse, rubbish or waste outside at any time under <br />any circumstances except as hereinafter permitted. <br /> <br />SECTION 504:02 Exceptions Exceptionsherefrom may be allowed <br />upon application and approval by the Director of the Minnesota <br />Pollution Control Agency and the Village Fire Marshal and the <br />IVillage Sanitarian. Exemption to conduct open burning under the <br />provision of this ordinance does not excuse a person from the <br />consequences, damages, or injuries which may result therefrom. <br />The following are exceptions for which application may be made: <br /> <br />(1) Fires purposely set for the instruction and training of <br />public and industrial fire-fighting personnel. <br />I <br /> <br />I (2) Fires set for the elimination of a fire hazard which <br />lcannot be abated by any other practicable means. <br /> <br />~ (3) The burning of trees, brush, grass and other vegetable <br />'atter in the clearing af"land, right Of, way maintenance operations <br />is permitted under the following conditions: <br /> <br />i (a) The prevailting winds at the time of burning must be <br />I away from any city or town. <br /> <br />I <br />I <br />I <br />II <br />'I <br />I, <br />I! <br />I <br />I <br /> <br />(b) The location of burning must not be within 1,000 <br />feet of an occupied residence other than those located on the <br />property on which the burning is conductt;d. <br /> <br />W"'," <br /> <br />I <br />) <br />ti <br />
