<br />. <br /> <br />,t Council may also compel the owners of vacant property within the V~llage <br />limits to keep the same clear of any brush, timber, or other material or <br />substance liable to receive or communicate fire to adjacent property. <br />In case the Council requires the repair of a building or structure, <br />the owner, lessee, or other person upon whom rests the duty to keep <br />the structure in repair and upon whom the order and direction to repair <br />is served, shall make such repairs as thereby directed. The order <br />and direction of the Council may require that the structure be closed <br />and not further used or occupied until all repairs required are made. <br /> <br />. <br />. ' , <br />r~' "".~ ... <br /> <br />A notice of the council's decision and order and of the requirements <br />of said decision, shall be forthwith served on the owner or occupant <br />by registered mail or by personal service~ and if the premises are not <br />occupied and the address of the owner is unknown, service may be made <br />by posting a copy of the notice on the premises. Service of notice <br />maybe proved by filing an affidavit of service in the office of the <br />Clerk setting forth the:manner and time thereof. <br /> <br />650:12. Abatement of Nuisance by Council. If, after such service <br />of notice, under Section 650:10, the person served fails to abate the <br />nuisance or make the necessary repairs, alterations. or changes in <br />accordance with the direction of the Council, the Council may cause <br />such nuisance to be abated at the expense of the Council and recover <br />such expenditure, plus an additional 25 per cent of such expenditure, <br />to cover administrative costs and overhead, by civil action against <br />the person or persons served~ or, if service has been had upon the owner <br />or occupant, by ordering the Clerk to extend such sum, plus 25 per cent <br />thereof. as a special assessment against the property upon which the <br />nuisance existed and to certify the same to the county Auditor of <br />Ramsey County, Minnesota. for collection in the same manner as taxes <br />and special assessments are certified and collected. <br /> <br />650:14. Provisions Supplementary. This Chapter is supplementary <br />and shall not deprive the Village of any of its powers in regard to <br />nuisances and the abatement thereof, whether derived from common law, <br />statute. or ordinance. The village may, at its option, proceed under <br />this Chapter or .under any other law or ordinance for the punishment of <br />maintaining and for the abatement of nuisances. <br /> <br />, <br />650:16. M.S.A. Definition Incorporated. No person shall commit <br />or maintain a public nuisance, as defined in Minnesota Statutes <br />Annotated, Section 616:01. or shall wilfully omit or refuse to perform <br />any legal duty relating to the removal of such nuisance~ and no person <br />shall let, or permit to be used, any building or portion thereof, <br />knowing that it is intended to be used for committing or maintaining <br />any such nuisance. <br /> <br />650:18. Penalties for Violation.. Any person who shall cause or <br />create a nuisance or permit any nuisance to be created or placed upon, <br />or to remain upon, any premises owned or occupied by him. and any person <br />who shall fail to comply with any order made under the provisions of <br />this ordinance upon conviction thereof shall be guilty of a misdemeanor. <br />
