Reported the Silver Lake Road Reconstruction Project

has been the major focus.

 

Public Hearing – Special Use Permit – Brightwood Hills Municipal Golf Course – LP02-005 / SP02-002

To consider an application for site plan review and special use permit to add onto an existing 16 foot fence near the 8th fairway of Brightwood Hills Municipal Golf Course.

The proposed addition would be a chain link fence 16 feet high and 140 feet in length.  The proposed fence would be of the same style and materials as the existing fence.  The purpose is to further protect homes on the south side of Greenview Drive.  Fences for special purposes and fences differing in construction, height, length or location from the requirements of this Section may be permitted in any district in the City by the issuance of a special use permit approved by the City Council.

 

Commissioner Schiferl asked how neighbors felt about the proposed fence.  Mr. Boylan reported at least one resident was concerned about golf balls and had been asking about a fence.  No negative comments had been received. 

 

Mary Berg, New Brighton Park and Recreation Department,  spoke as a representative of the golf course in support of the fence to protect golfers and homeowners.

Mr. Bill Moses of  2375 Hamilton Court addressed the Planning Commission to make sure there were no plans for a fence that would be blocking the view from his property.  He was assured that is not the plan. 

 

Moved and seconded to  CLOSE THE PUBLIC HEARING.   6 Ayes, 0 Nayes, Motion Carried. 

 

Motion by Schiferl, Seconded by Zisla to  WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF LP02-005 / SP02-002, SUBJECT TO THE FOLLOWING CONDITIONS: 

 

1.                  Fence post placement is approved by City Forester.

Public Hearing – Rezoning of the Property at 1950 Old Hwy. 8 from I-2 to I-1

City of New Brighton – RZ 02-001

The proposed rezoning is for the parcel the current Johnson Screens building is located on.  The Comprehensive Plan calls for the future land use of this parcel to be Light Industrial.  The Johnson Screens parcel is currently zoned I-2, Heavy Industrial and is inconsistent with the City’s Comprehensive Plan.  To bring this property in compliance with the Comprehensive Plan, the property will need to be rezoned to I-1, Light Industrial. 

 

Rezoning the property will insure that future development of this site will be consistent with the Comprehensive Plan. 

 

Moved and Seconded to CLOSE THE PUBLIC HEARING.   6 Ayes 0 Nays, Motion Carried. 

 

Motion by Zisla, and seconded to RECOMMEND APPROVAL OF RZ 02-001 AND ADOPT THE ATTACHED RESOLUTION, REZONING THE PARCEL LOCATED AT 1950 OLD HWY 8 OWNED BY JOHNSON SCREENS (PIN: 17-30-23-44-0006), from I-2, HEAVY INDUSTRIAL TO I-1, LIGHT INDUSTRIAL.

Public Hearing – Zoning Code Amendment – City of New Brighton

Note the Public Hearing for this Zoning Code Amendment is related to the Rezoning Public Hearing above.    

Proposed text changes to add “metal plating” to Section 6-030(5)

The language proposed to be added to the City’s Zoning Code under the I-1, Light Industrial allowable uses is:  ­Welded screen manufacturing, conducted entirely within a fully enclosed, climate controlled building and not involving electroplating or stamping.   Staff and the City Attorney believe the above language will allow Johnson Screens to continue their current operations within an I-1 zoning district and will limit heavy industrial type uses from operating within a Light Industrial zone. 

 

There were no public or business persons present to speak to this issue.

 

There was considerable discussion between commissioners and staff regarding the terminology and uses and future situations which might develop. 

 

Moved and Seconded to RECOMMEND APPROVAL of the Zoning Code Amendment as follows: 

 

Section 1.         The New Brighton Code of Ordinances is amended by adding to paragraph (5) letter (JJ) to Section 6-030, Permitted Uses in an I-1 District, as follows: 

 

 JJ.­­                   Welded screen manufacturing, conducted entirely within a fully enclosed,

                        climate controlled building and not involving electroplating or stamping.

 Public Hearing – Preliminary Review of Planned Residential Development,

                               Nonconforming Use Permit, Site Plan and Preliminary Plat -

                               CSS Builders / Lampert Architects – PRD02-001, LP02-006,

                                PL02-003, NC02-002

 

Consideration of a request to construct a 72 unit condominium building and subdivide the property into two lots of record.  The property is located at 219, 221, and 321 Old Highway 8 NW, and is zoned R-3B, Multiple Family Residential.  This is a preliminary review and recommendation.  The City Council next week will review that and approve or deny the preliminary site plan and planned residential development.  If the applicant so chooses, he can come forth with a final review recommendation from this body and then a final approval or denial by the City Council. 

 

Mr. Boylan reviewed the request and background and pertinent information for the commissioners.  There were questions and answers between commissioners and staff.

Beverly Aplikowski  of Lakeside Homes spoke, bringing up a concern about transportation and the cars that the development would generate.  Feels traffic concerns on Old Hwy 8 are going to have to be addressed with all the projects planned. 

 

Moved by Zisla, Seconded by Schiferl to CLOSE THE PUBLIC HEARING.

Commissioner Zisla had questions regarding the No. 4 condition of a trail easement.

Neil Hyde with CSS Builders, representing the developer, spoke stating they understood

the part of the process that dealt with  the trail and easements thereof, that they were willing to work with the City in consideration of the easement across the property for the

trail because this is something the City has had in planning and in the  works for a long time.   They did not think there was going to be any more responsibility by the developer for the trail itself, other than to accommodate the City with some possible easement and that was the limited role. 

 

Motion by Zisla, Seconded by Schiferl, to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION APPROVING PRD02-001, LP02-006, PL02-001

NC02-001, subject to the following conditions:

 

1.                  All property owners shall sign City Applications.

2.                  Approval of a permit by the Rice Creek Watershed District.

3.                  Approval of a Permit from the Ramsey County Department of Transportation for the proposed new curb cuts on Old Highway 8.

4.                  A trail easement is provided to connect Old Highway 8 and Jones Lake and an easement agreement is approved by the City Park and Recreation Director, the City Planner and the City Attorney.

5.                  A comprehensive sign plan is approved by the City Planner.

6.                  Light plans for the proposed building are submitted to the City detailing materials, height and supportive data to be approved by the City Council. 

7.                  Light plans are submitted for the existing building and approved by the City Council. 

8.                  The proposed grading plan shall be subject to review and approval of the City Engineer.

9.                  Landscape plans are resubmitted, subject to review and approval of the City Forester. 

10.              Landscape plans to improve the existing building are submitted and approved by the City Council. 

11.              The entrance and parking areas are redesigned to better accommodate fire safety vehicles to be approved by the Fire Inspector and the City Council. 

12.              Submitted site plan for the existing building and site address parking requirements and reduces nonconformities where feasible.                                                  

 

General Business: 

 

Site Plan Review for 1200 Foss Road – Lakeside Homes.

Manufactured home park proposes expanding a parking area.  Applicant is proposing to reconfigure the existing parking along East Lane by cutting into the berm 20 feet to provide additional parking for Lakeside Homes residents.  The applicant also wishes to shift the north driveway to better align with existing curb cut on Old Highway 8.

 

Beverly Aplikowski, of Lakeside Homes, was available to the commissioners for questions.  She reported that since they will be redoing the roads anyway, it is a good time to be adding parking space as there is an identified need for this.  She also stated better landscaping can be done with shifting the north driveway to better align with the existing curb cut. 

 

Motion made and seconded to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF LP 02-003 TO THE CITY COUNCIL, SUBJECT TO THE FOLLOWING CONDITIONS:

 

1.      The dumpster is screened from the Foss Road right-of-way, to be approved by the City. 

2.      Lost trees due to construction are replaced at a 1 to 1 ratio. 

 

Zoning Code Discussion – Building Setback discussion

A resident visited with staff about constructing a front porch at their property at 2909 Seminary Drive.  The proposed porch would encroach into the front yard setback. 

 

Through Section 4-0430 (3) B, the required setback may be reduced to 24 feet under a Special Use Permit provided the addition is of the same exterior materials, the base of the structure is not open, and that the addition does not exceed 35 % of the width of the dwelling. 

 

The homeowner believes the site standards and special use standards found in the Zoning Code would not adequately address his interests.  The resident argues that following Code would create a design that would not fit with the architectural style of his home. 

Mr. Polacek and his wife Dee were present to address the Commissioners.  They explained their reasoning for wanting a front porch and how it would affect things. 

 

Motion by Schiferl, Seconded by Jim O’Brien , to ask the Council to direct staff to examine changing code to allow porches that stay open, with the idea of enhancing community.

Sign discussion per the Chamber of Commerce.

Chamber of Commerce has approached staff on behalf of a couple of businesses along Silver Lake Road concerned about exposure during  the reconstruction of Silver Lake Road north of 694.  Mr. Boylan described the use of some temporary banners by businesses could be extended to sunset when the project is over.  Also, orange and black highway construction signs could state road is open to businesses. 

 

There was consensus of commissioners that there should be a provision to relax the standards for signage during the construction,  there should be care and attention to have the signs be safe and not be cluttered and be well managed.   Detail beyond that should be left to the people working on the project.  We should be sympathetic to the needs of the businesses. 

 

Announcements and Updates

Mr. Boylan reported that he and Kevin Locke attended the National American Planning Conference in Chicago for four days.
