PLANNING COMMISSION PROCEEDINGS

CITY OF NEW BRIGHTON

 

 

 

Regular Meeting – March 16, 2004 at 7:30 p.m.

 

 

Present:    Commissioners Larry Baker, Jim O’Brien, Norm Schiferl, Tom O’Keefe,

       Karen Mann, Bruce Howard and Paul Zisal

·        Council Action  -  

Mary Burg, City Council Member reported the City Hall remodeling

project is moving along well.

She also reported Mayor Larson had attended the National Mayors’

Conference in Washington, D.C. and spent time with our legislators

and spoke with them about the I-35W freeway and the NW Corridor and how it impacts our city in years to come.

Public Hearing:  FP02-002 Final Plat Amendment for Lindsey CourtBruce Nedegaard.

Consideration of application by Nedegaard Custom Homes to amend the approved Lindsey Court Final Plat.  The Council approved a Planned Residential Development (PRD) for Lindsey Court Townhomes in October 22, 2002.  Since then, three sets of townhomes have been constructed.  The developer has indicated to staff that the housing market indicates a larger footprint to the buildings as originally planned.  Consequently, the size of the individual lots is too small for the proposed structures.  The applicant has indicated that there are no changes to the approved site plan but the following change to the approved Plat: 

Lots 1, 2, 3 and 4, Block 3 are increased from 1,656 sq. ft. to 1,944 sq. ft. (54’ x 36’).

That is, the depth of each lot is proposed to increase by 8 feet.  The developer would accomplish this by extending each unit to the south. 

 

With the exception of the extended four lots in Block 3, the proposal is substantially the same as what the Council approved in 2002. 

 

Gene Delaune of 2828 Linden Drive, spoke to the Commissioners regarding the runoff pond and the capacity and safety issues. 

 

 

Motion by Baker, Second by Schiferl to CLOSE THE PUBLIC HEARING.

Motion by Schiferl, Second by Zisla, to   RECOMMEND APPROVAL TO THE COUNCIL  OF FP02-002 amended Lindsey Court Plat project, subject to the conditions listed below: 

1)      Continued compliance with PRD02-02.

2)      The applicant should re-draft the grading plan for approval by the City Engineer.

3)      The applicant files the amended plat with Ramsey County and provide the City with a copy of the amended drawing.

4)      The developer will provide new calculations based on additional impervious surface.

Public Hearing:  NC 04-01 – Type 4 Non-conforming Use Permit – Cuppa Chiodo’s Café 2020 Silver Lake Road – Wendy Frances & Gina Bauman

Consideration of a Type 4 non-conforming use permit to redevelop the vacant Dairy Queen building at 2020 Silver Lake Road NW.  The site is zoned B-3, General Business. 

Where Type 4 non-conformities are present and are proposed to continue resumption of use after discontinuance of use for six or more months, it shall be allowed only upon permission of the City Council.  The Dairy Queen has been closed for over a year. 

 

Mr. Boylan reviewed the background information and staff report for the Commissioners. 

There were questions and answers between, Commissioners, Staff and Applicants. 

 

Motion by Baker,  Second by Zisla  to CLOSE THE PUBLIC HEARING.

Motion by Zisla, Second by Schiferl to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF NC 04-02

with the following conditions:

 

1)  The applicant shall provide a new landscape plan to be reviewed and approved             

                  by the City Forester.

            2)   Sign Plans shall be submitted for approval by the City Planner.

Public Hearing:  FP04-01 - Final Plat – Beisswenger’s Hardware Addition – Mr. David Black on behalf of the City of New Brighton

Consideration of a Final Plat for four parcels (1823, 1853, 1873, and Parcel “B” of 1951 Old Highway 8) to a single lot for a proposed hardware store.  The City Council of New Brighton approved a Preliminary Plat on February 24, 2002. 

 

Mr. Boylan reviewed the history and background of the project for the Commissioners.

 

Motion by Baker, Second by O’Keefe to CLOSE THE PUBLIC HEARING.

 

7 Ayes, 0 Nays, Motion Carried.  

 

Motion by Baker, Second by O’Keefe to WAIVE THE READING AND RECOMMEND APPROVAL TO THE CITY COUNCIL OF  FP-04-01 SUBJECT TO COMPLIANCE WITH THE FOLLOWING CONDITION: 

 

1)      The Final Plat shall show a transportation easement 120 feet north of the Ramsey County Highway 96 right-of-way line.
