CITY OF NEW BRIGHTON

 

 

Regular Meeting –May 18, 2004 at 7:30 p.m.

 

Present:    Commissioners Jim O’Brien, Norm Schiferl, Karen Mann and Bruce Howard

      

Absent:     Commissioner Larry Baker and Commissioner Paul Zisla

·        Council Action  -  

Mary Burg, City Council Member reported things are still on hold with the NW Quadrant.  She reported there is a positive article on Multi-housing news.com about New Brighton. She recognized that it is National Public Works Week.

 

·        Approval of Minutes – April minutes were not available.

 

·        Agenda Review:   Announcement of Bike to Work Week.

 

Public Hearing:  VN04-01 – Variance for a proposed addition onto an existing detached garage larger than 600 sq. ft. – Mr. Paul Schweppe.

 Consideration of a variance for a proposed addition onto an existing detached garage larger than 600 sq. ft. on a single family lot at 1227 12th Ave. NW.  The site is zoned R-1, Single Family Residential.  The property has both an attached and detached garage. Section 4-530(D) states that when an attached garage is present, no detached accessory building or garage shall exceed 600 square feet.  The existing detached garage is 616 sq. ft..The applicant wishes to expand the structure by 227 sq. ft. for a total detached garage size of 843 sq. ft..  The applicant is seeking a 243 sq. ft. size variance to expand the existing non-conforming detached structure to a total size of 843 sq. ft.

 

The applicant wishes to increase his garage so as to eliminate his outdoor storage of yard and driveway equipment. 

 

Mr. Boylan reviewed the request and staff report for the Commissioners.  He reported that this was before the Planning Commission last month as a Special Use Permit  as inadvertently it had been assumed that Mr. Schweppe would be converting his present garage into living space.  It now needs to be revisited as a variance request. 

 

The applicant, Mr. Paul Schweppe, made an emotional appeal to the Commissioners describing what he feels are unique characteristics of his property and undue hardship   

for him due to the vast amount of land and the need for upkeep in all seasons requiring several pieces of equipment to be housed to maintain the property. 

 

It was stated that Mr. Schweppe’s request probably does not meet the variance criteria but a suggestion could be to consider establishing a shoreland overlay district which would take into account the size of the lots and the types of things Mr. Schweppe is trying to accomplish. 

 

Motion by O’Brien, Second by Schiferl.to CLOSE THE PUBLIC HEARING.

Motion by Schiferl, Second by Howard, to DENY VN04-01.

Motion by Schiferl, Second by Mann that the Planning Commission recommend that the Council direct staff to examine options for amending the zoning code that would address the unique characteristics of lakeside properties in the city. 

 

Public Hearing:  Zoning Ordinance Amendment – Proposal to amend the special uses section of Chapter 6, Industrial Districts. 

The Planning Commission is asked by the City to consider amending the Zoning Ordinance Section 6-140 by adding a new paragraph (6) to the I-2 Industrial zone text regulations.  The change would be:

Amend 6-140 (6) by adding the following paragraph:

 

6)         Storage of salt, sand, or other similar road treatment materials by public road authorities in structures not meeting requirements found in Sec. 6-390. (12).

 

Motion by O’Brien, Second by Howard, to CLOSE THE PUBLIC HEARING.

Motion by Howard, Second by Mann, to WAIVE THE READING AND RECOMMEND APPROVAL OF THE ATTACHED ZONING ORDINANCE AMENDMENT PERTAINING TO SECTION 6-140 I-2, HEAVY INDUSTRIAL ZONE.

 

3 Ayes, 0 Nays, Commissioner O’Brien abstaining, MOTION CARRIED. 

 

Public Hearing:  SP04-02/LP04-03  Special Use Permit for City maintenance facility expansion, construction of salt storage facility at 700 5th St. NWLes Proper, City Engineer, on behalf of the City of New Brighton.

Consideration of an application for a special use permit and site plan review for the development of a new structure at the City Maintenance Facility located at 700 5th St. NW.  The City proposes to add a 6,300 sq. ft. structure to cover existing road treatment material.  The building is open on all four sides and serves to cover the sand and salt supplies for winter street de-icing purposes. 

Motion by O’Brien, Second by Schiferl, to CLOSE THE PUBLIC HEARING.

It was explained that by covering the pile of road treatment material, the proposed structure will assist implementation of the Best Management Practices by preventing rainwater from washing salt into the sewer. 

 

Mr. Boylan presented the plan and Mr. Proper answered questions for the Commissioners.  

 

Motion by Schiferl, Second by Mann, to RECOMMEND APPROVAL TO THE city Council with the following conditions: 

1)      The Council shall amend Section 6-140(6) of the Zoning Code to allow such a structure for storage of road materials. 

2)      There shall be no storage of vehicles or flammable materials within the proposed structure. 

 

3 Ayes, 0 Nays, Commissioner O’Brien abstaining, MOTION CARRIED. 

 

Public Hearing:  SP 04-05 – Special Use Permit for a proposed front entryway – Mr. Howard Theis.

Consideration of a request for a Special Use Permit to construct an addition onto an existing single family home at 1883 Sioux Blvd. N.W.  The proposed addition consists of a remodeled entryway and expanded garage.  The site is zoned R-1, Single Family Residential and the proposed addition sits within the 30 foot front yard setback requirement.  The proposed garage addition will abide by all setbacks; however, the entryway proposal encroaches into the front yard setback. 

 

Mr. Boylan reviewed the plan for the Commissioners. 

 

Motion by O’Brien, Second by Schiferl,  to CLOSE THE PUBLIC HEARING.

Motion by Schiferl, Second by Mann to WAIVE THE READING AND RECOMMEND APPROVAL OF SP 04-05.

Public Hearing:  SP 04-06 – Special Use Permit for cellular tower at 2400 Mississippi St. N.W. –Chuck Beisner, T-Mobile. 

Consideration of an application for a special use permit to construct a 65 foot pole to house digital wireless telephone antenna.  At the bottom of the pole, T-Mobile is proposing to construct two 6 foot tall and two 4 foot tall cabinets.  The property is located at 2400 Mississippi Street, which is the Creekview Park site, which also houses City Well # 12. 

 

Mr. Boylan reviewed the findings for the Commissioners. 

 

Chuck Beisner of Midwest Real Estate Services, on behalf of T-Mobile, addressed Commissioners and answered questions. 

 

Larry Long asked some questions of Mr. Beisner. 

 

Motion by O’Brien, Second by Mann,  to CLOSE THE PUBLIC HEARING.

There was considerable discussion among Commissioners, staff and applicant. 

 

Motion by O’Brien, Second by Howard, to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF SP04-06,

subject to the following conditions: 

 

1)         The applicant shall reconfigure the planting plan to provide screening to the west and south to be approved by the City Planner.

 

2)         Compliance with all FCC regulations.

 

3)         The lease arrangement shall be subject to review and approval of City staff, City Council and the City Attorney.                                                            

 

4)         Issuance of a building permit for construction of the pole. 

 

5)         Referral to Park and Rec. Commission for input.
