Regular Meeting –June 15, 2004 at 7:30 p.m.

 

Present:    Commissioners Larry Baker, Jim O’Brien, Norm Schiferl, Karen Mann,

       Bruce Howard and  Paul Zisla

      

 

Absent:     Commissioners Tom O’Keefe and Karen Mann

Mary Burg, City Council Member reported on some changes to two polling places to allow for better accessibility.    Part of the Pike Lake School precinct location has been moved to St. John the Baptist Church and Bel Air School precinct No. 2, has been moved to Salem Covenant Church on Silver Lake Road.

Public Hearing:  NC04-02, LP04-04   Nonconforming Use Permit & Site Plan – Faulkner Construction on behalf of Doug DeFresne of Midwest Powder Coating, Inc. at 720  1st St.  SW.

Consideration of an application by Mr. James Faulkner, Architect, on behalf of Assembly, Packaging & Screen Printing for a Non-confirming Use Permit and Site Plan.

The purpose of the request is to construct a 14,000 square foot addition onto the existing building at 750 1st St. SW.  The site has the following type 4 non-conformities: 

 

1.      The employee parking area does not have curb and gutter on the west side; and encroaches into the front yard setback;

2.      The existing structure encroaches into the rear yard setback;

3.      The landscaping is dead or missing; and

4.      Outdoor storage is not screened from the right-of-way.

 

Mr. Boylan reviewed the Site Plan for the Commissioners.  The applicant’s site plan reduces the number of non-conformities by the addition of a paved parking area with curb and gutter, improving the landscaping and removing the unscreened outdoor storage.  The proposed site plan meets the regulations for Type 4 Non-conformities. 

 

Mr. Faulkner, Architect of the project, also spoke to the Commissioners and gave them a chance to ask questions. 

Motion by O’Brien, Second by Zisla to close the public hearing .

 

6 Ayes, 0 Nays,  motion carried. 

 

Motion by O’Brien, Second by Zisla to  waive the reading and adopt the attached resolution recommending approval of the nonconforming use permit and site plan NC-02-02 and LP04-04 subject to the following conditions: 

 

1.                  Review by and compliance with Rice Creek Watershed District. 

2.                  A drawing for the west elevation is submitted and approved by the City Planner.

3.                  A permit is applied for and approved by the City Engineer for the new curb cut.

4.                  An ADA parking stall is added and drafted on submitted building permit plans. 

5.                  Landscape plans are resubmitted to be approved by the City Planner.

General Business: 

Overlay Discussion for R-1, Single Family Residential Zone – Research and review of setback standards, lot coverage and yard definitions. Patrick Boylan, City Planner.

 

The Planning Commission and the New Brighton City Council at their respective May meetings, directed City Staff to research and provide code options whereby the City Code might be amended to allow additional diversity of house, garage, accessory structure design on large lake lots.  They were to focus on bulk coverage requirements, quantity of detached accessory structures and review of “yard” definitions. 

 

At the June 15th meeting, Mr. Boylan presented some options to Commissioners, based on his research and study of the subject.  (See attached Planning Report).

 

The Commissioners studiously discussed the information presented, including review of maps, definitions of riparian lots, information provided on codes of other cities,  similar options for other types of large lots. What is the front yard, road side or lakeside?  Lot size vs. buildable lot size.  Could applicants redesign their structures to make them conform?  Could property owners use off site storage instead of building accessory structures?

 

After much discussion, it was the consensus of the Commissioners to have staff report to the City Council on the above.  They also seek more information on an area such as Lake Minnetonka.  Commissioners want to move slowly on any changes, so as not to create a bigger problem than they would be solving. 

Announcements and Updates: 

There will be a joint City Council, Planning Commission, Parks and Rec. and EDC reception to meet the final candidates for the position of Community Development Director.  The reception is Tuesday, June 29th at 5:30 p.m. at the Family Service Center. 

 

There will be an I-35 Planning Meeting on Thursday, June 17th at 6:30 p.m. at the MN Dot Training Facility at Co. Rd. I.
