CITY OF NEW BRIGHTON

 

 

Regular Meeting –September 21, 2004 at 7:30 p.m.

Council Action  -  

      Mary Burg, City Council Member reported there will be a town hall       meeting October 9 at the Family Service Center from 8 a.m. to Noon.

       The Public Safety Dept. won an international award for crime free

        housing efforts.  She congratulated Director Jacobson and his

        department who will be going to L.A. in Nov. for the ceremony.

 

·        Approval of Minutes –August 17, 2004, minutes were not available. 

 

Agenda Review:    Item 8 B added to introduce new staff member.  Also, addition of two announcements. 

 

Public Hearing:  SP 04-11  Special Use Permit for a proposed detached garage larger than 624 sq. ft. – Paul Schweppe.

Consideration of a request for  a Special Use Permit to construct a garage larger than 624 sq. ft. on a single family lot at 1227 12th Ave. NW.  The site is zoned R-1, Single Family Residential.  The lot currently has a 616 sw. ft. detached garage;  the applicant wishes to expand the structure by 227 sq. ft. for a total detached garage size of 843 sq. ft.

 

Mr. Boylan reviewed the background and site plan for the Commissioners and the audience. He reviewed the changes the Planning Commission and City Council had made last month, amending Section 4-530 Accessory Structures.  There was no one in the audience who wished to speak during the Public Hearing for this Special Use Permit request.

 

Motion by Baker, second by O’Brien to CLOSE THE PUBLIC HEARING.

Motion by O’Brien, second by O’Keefe, to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF SP 04-11, subject to the following conditions:

1.      Roof and exterior color and material must be consistent and complimentary with the principal structure. 

2.      If deemed necessary by the City Council, landscape screening shall be provided to lessen visual impact from adjacent properties. 

3.      No commercial or home occupation activity shall be conducted within the accessory building. 

4.      The City Manager will make a determination of front yard / back yard of this residential riparian lot.

Public Hearing:   SP 04-10  Special Use Permit for a proposed front yard encroachment  - Ms. Jennifer Tenenbaum

Consideration of an application for a Special Use Permit to construct an addition onto the existing home at 2015 Long Lake Road NW.  The site is zoned R-1, Single Family Residential.  The proposed addition encroaches into the required 30 foot front yard setback.   Section 4-040 (3) B states that in required front yards, the required setback may be reduced to twenty-four feet subject to the approval of a Special use Permit and conditions found in Section 4-040 (3) B 1-4.  The applicant is proposing to add onto the kitchen, which is proposed to encroach into the front yard setback by 2 feet.  This addition is part of a larger project where a second story is planned to be built. 

 

Mr. Boylan reviewed the background information and site plan for the Commissioners and audience. The applicant was present. No one wished to speak to the issue from the audience. 

 

Motion by Baker, second by O’Brien to CLOSE THE PUBLIC HEARING.

Hearing no further discussion, Motion by Mann, second by Howard, to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION, RECOMMENDING APPROVAL OF SP 04-10.

Public Hearing:  SP 04-12 / NC04-04 – Special Use Permit for a proposed detached garage larger than 464 sq. ft.. – Mike and Janell Zappa.

Consideration of an application for a Special Use Permit to construct a garage larger than 624 sq. ft. on a single family lot at 721 3rd Avenue NW.  The site is zoned R-1A, Single Family Residential.  The applicant wishes to expand the existing detached garage to a total of 1,038 sq. ft.

 

Mr. Boylan reviewed the background information and site plan for the Commissioners and audience.  The applicant did not submit detailed elevation drawings of the attached garage.  The applicants were present.  No one in the audience spoke to the issue and staff had received no communications about the proposal. 

 

Motion by Baker, second by O’Brien to CLOSE THE PUBLIC HEARING.

There was some additional discussion among the Commission regarding the roof and overall design of the garage.  Commissioners directed the applicant to consider the design and submit new elevation drawings to the City Planner before the Council considers the application.

 

Motion by Baker, second by Howard to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF SP 04-12 with the following conditions:

 

1.                  Building elevation will be submitted to staff before the City Council Meeting.

2.                  The driveway shall be paved up to the addition.

3.                  The maximum size shall be 1,064 sq. ft.

Public Hearing:  NC04-03 / SP04 – 13 / LP04-06  Innsbruck Care Center Expansion

Special Use Permit, Non-Conforming Use Permit & Site Plan Review. – Mina Adsit, AIA on behalf of Benedictine Health System. 

Consideration of an application by Ms. Mina Adsix on behalf of Innsbruck Care Center, for a Special Use Permit, a Nonconforming Use Permit, and Site Plan Review to expand the existing facility located at 2800 I-694 Service Drive.

 

The purpose of the request is to construct an 18,160 square foot addition onto the existing 39,100 square foot building and expand the parking area.   The site does not have screening near the east lot line along the parking area and a portion of the existing building and parking area encroach into the front yard setback.  The Code identifies these as Type 4 Nonconforming Uses, which requires a public hearing.  The nursing home use is a Special Use and any expansion of the facility also requires a public hearing. 

 

On January 28, 2003, the City Council approved a non-conforming use permit for the site.  That site plan was never developed.  This proposed plan is slightly smaller than the 2003, approved site plan (5,940 sq. ft.).

 

Mr. Boylan reviewed the background of the project and a brief review of the site plan. 

Mina Adsit, Project Coordinator, presented the major portion of the proposal.  Also available was Sue Ager, Project Administrator, and Michaela Olchin, Civil Engineer. 

Ms. Adsit described the differences between the current proposal and the previous proposal.  She thoroughly reviewed the details of the project and described what she referred to as a low profile residential friendly face. 

 

An audience member spoke and asked questions regarding the amount of parking and the pond.  There was a lot of explanation and describing of the ponding issues.  Plantings were also discussed. 

 

Delores Walstrom of 2838 Linden Drive asked about the distance from the building to the curb.  She was told it was 65 feet.  She also called attention to the fact there would be no barriers on the north side to stop noise from 694.  She also had questions regarding lighting. 

 

Motion by Baker, second by O’Brien to CLOSE THE PUBLIC HEARING.

Motion by O’Brien, second by Zisla, to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION RECOMMENDING APPROVAL OF THE  NON-CONFORMING USE PERMIT AND SITE PLAN NC04-03 /SP04-13 / LP04-06 , subject to the following conditions: 

 

1.                  The right-of-way vacation approved by the City of New Brighton in 1995, shall be recorded.  The applicant shall submit to the City documentation proof of the I-694 Service Drive right-of-way vacation prior to final occupancy. 

2.                  The landscape plan shall be modified by substituting the “nikko” Blue hydrangea with “endless summer” variety and shall substitute ponderosa pine with Austrian pine variety.

General Business: 

 

Civil Engineer, Kerry Thorne discussed  the National Pollution Discharge Elimination Systems.   As part of the Federal mandate from the Environmental Protection Agency, the City of New Brighton is required to address several issues related to storm water runoff. 

The New Brighton engineering staff has worked within the context of the National Pollution Discharge Elimination Systems (NPDES) to develop best management practices (BPMs).  They are addressing one of the BMPs as it relates to site construction and how to best manage storm water runoff.   This is ongoing and we will all be hearing further about this. 

 

Announcements: 

 

Mr. Boylan announced there will be a Town Hall Meeting on Saturday, October 9 from 8:00 a.m. to 12 Noon. 

 

It was also announced there will be an open house at City Hall on Tuesday, October 26 from 5:00 p.m. to 7:30 p.m..

 

MnAPA State Conference – The 2004 Minnesota chapter of the American Planning Association is being held at Arrowwood Resort in Alexandria, September 29th – October 1, 2004. 

 

Mr. Boylan formally announced and welcomed Mr. Grant Fernelius, the new Community Development Director.
