Request

 

 

To re-plat 4 parcels (1823, 1853, 1873, and Parcel “B” of 1951 Old Highway 8) to a single lot for a proposed hardware store.  The City Council of New Brighton approved a site plan for a new hardware store building January 13, 2004.  The City is actively acquiring the remaining parcels.

Submitted Data for Preliminary Plat

 

The applicant has submitted a current Certificate of Survey showing existing conditions with all applicable data required by the City Code including proposed name of the new subdivision, legal description of the property, names of owner, surveyor, engineer, and appropriate cartographic data such as a scale and north arrow.

 

The existing condition map shows survey lines and indicates appropriate zoning data including building setbacks, rights-of-way, and existing utilities.

 

The proposed Plat shows all of the necessary data including a proposal to vacate excess Old Highway 8 right-of-way

 

 

Sec. 26-33. Qualifications Governing Approval of Preliminary Plat.

 

The Planning Commission may return a conditional recommendation. The City Council may require  revisions as it deems necessary for the health, safety, general welfare, order and convenience of the City.  The approval of a preliminary plat indicates that the subdivider may proceed toward fulfilling the necessary steps for approval of the final plat in accordance with the terms of approval. No plat will be approved for a subdivision which covers an area subject to periodic flooding or which contains extremely poor drainage facilities and which would make adequate drainage of the streets and lots impossible.

 

 

 

Staff believes that the applicant will proceed with the necessary steps toward filing a final plat  and that adequate drainage during and post-development will be provided for the site so as to not cause flooding. 

 

 

Staff Comments

 

 

Copies of the proposed plat was forwarded to Mn/DOT and Ramsey County for review. 

 

The approved site plan for Beisswenger’s Do It Best Hardware Store is for a triangle shaped pond in the southern tip of the site.  Conversations with Ramsey County highway engineers revealed a desire to re-design the pond.  A redesigned pond would be a regional pond that would control run off for both the future hardware store and adjacent County highways.  To accomplish this goal, the County desires a transportation easement 120 feet north of the Highway 96 right-of-way.  The City Planner and the City Engineer believe this is acceptable.  The Planning Commission should recommend this to the Council for Final Plan consideration.

 

At time of writing, the City has not received any comments from Mn/DOT about the proposed plat.

 

 

Staff believes that the specific elements in the proposal are consistent with the regulations found

in Chapter 26, Subdivisions.

 

 

Recommendation

 

 

Approval

 

Motion to waive the reading and recommend approval to the City Council PL 04-01 Subject to compliance with the following conditions:

 

  1. The City Engineer shall review the Preliminary Plat prior to hearing at the City Council.
  2. The applicant shall file all necessary plans with Ramsey County. 
  3. The Final Plat shall show a transportation easement 120 feet north of the Ramsey County Highway 96 right-of-way line.

 

Staff Recommendation

 

Staff recommends approval of the request subject to the conditions outlined above.
