On December 9, 2003, the Council authorized a minor subdivision of 1951 Old Highway 8 into Parcel “A” and Parcel “B.”  Both parcels are zoned I-1, Light Industrial.  Parcel A is still owned by Thermo King; there are no proposed changes to the zoning of this parcel.  Parcel B was purchased by the City of New Brighton. 

 

The Beisswenger hardware store project calls for the assembly of several parcels of land.  All of the parcels for the proposed store are zoned MX, Mixed Use.  Parcel “B” is located at 1951 Old Highway 8 NW (former Thermo King parcel) and is zoned I-1, Light Industrial.

Staff Notes

 

Section 8-350, Planning Commission to Act

The Zoning Code states that the City Council shall not rezone any land or area in any zoning district without such rezoning proposal having first been reviewed by the Planning Commission at a public hearing.

 

Notification was sent to all property owners within 350 feet of the subject site and Public Notice was published in the New Brighton Bulletin.  As of time of writing, Staff has not received any contact or correspondence regarding the re-zoning.

 

 

Council Resolution 04-09

On January 8, 2004, the Council approved a site plan for a new Beisswenger Hardware Store with the condition that all necessary zoning approvals shall are submitted to the City including a rezoning of Parcel “B.”

 

 

RECOMMENDATION:

 

Approval

Motion to recommend approval to the Council of application RZ 04-01 rezoning the Parcel “B” located at 1951 Old Highway 8 from I-1, Light Industrial to MX, Mixed Use with the following conditions:

  1. The lot is re-platted into the Beisswenger Hardware Addition to New Brighton.
