ORDINANCE NO. 217 VILLAGE OF NEW BRIGHTON COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE REGULATING THE CREATION, DAMMING, FILLING, DREDGING AND ELIMINATION OF WATERS AND WATERWAYS AND THE ARTIFICIAL CHANGE OF WATER LEVELS THEREOF, WITHIN THE 'ILLAGE OF NEW BRIGHTON, REQUIRING PERMITS THEREFOR AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. The Vi I lage Counci I of the Vi I lage of New Brighton does ordain as fol lows: Section I. DEFINITION. As used in this ordinance, the terms wate s and/or waterways shal I include all public waterways as defined by Minneso a IStatutes Section 105.38, subd. I and shal I also include al I bodies of wat r, natural or artificial, including ponds, streams, lakes, swamps, and ditch s Which are a part of or contribute to the collection, runoff or storage of surface waters within the Vii lage of New Brighton, or directly or indirec , affect the collection, transportation, storage or disposal of the storm a surface waters system in the Vi I lage of New Brighton. Section 2. PERMIT REQUIRED. (I) No person, firm or corporation shal I cause or permit any wat or waterways as defined herein to be created, dammed, altered, fi I led, dr - dged or eliminated, or cause the water level elevation thereof to be arti i- cial Iy altered without first securing a permit therefrom from the Village Council of New Brighton. (2) Applications for permits shall be made in writing upon print I forms furnished by the Vi Ilage Clerk. I' ,I (3) Applications for permits shall be accompanied with a complet and detai led description of the proposed work together with complete plan and topographical survey map clearly illustrating the proposed work and i s effect upon existing waters and water handling faci lities. (4) A fee of $25.00 shal I be paid to the Village and upon the filing of such application to defray the costs of investigation and considering such application. Section 3. PROCEDURE. Each appl ication for permit shal I be ref err d I to the Vi Ilage Engineer for his written report thereon. After receipt of the Engineer's report, the Vi Ilage Council may grant or deny such application The Vi Ilage Council may hold a public hearing on such application after p b- llished notice thereof at least one (I) week in advance of such hearing. I Section 4. PENALTY. Every person violating any provision of this ordinance shal I be guilty of a misdomeanor any upon conviction shal I be 'punished by a fine of not more than $100.00 or by imprisonment in the Cou ty Jail for not more than 90 days. A separate offense shall be deemed commi ted upon each day during or on which a violation occurs or continues. i II ! ,Ii (I
