<br />I I " <br /> 'I I <br /> ~ I \ I, i <br />--~ " " I, <br />I , <br /> <br />RESOLUTION No. 05-032 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF FP 05~03. <br /> <br />WHEREAS, an application has been made by MWF Properties for a Final Plat at 219 Old <br />Highway 8 SW. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a minor subdivision was filed with the City of New <br />Brighton on March 15,2005; <br />2. The City Engineer reviewed the application and found it to be acceptable. <br />3. The Planning Commission reviewed the final plat on April 18, 2005 and <br />recommended approval with conditions to the City Council; and, <br />4. The City Council considered the application on April 26, 2005. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact <br />in respect to FP 05-03: <br />1. The subject site is zoned R-3B, Multiple Family Residential. <br />2. The site is located at 219 Old Highway 8 SW. <br />3. The resulting plat will create a lot of245,113 sq. ft. <br />4. The new Plat will be known as Lakes Run Apartments described as per <br />Attachment A. <br />5. The site is adjacent to Lake Jones. <br />6. Park and trail development policy within the City of New Brighton <br />Comprehensive Plan calls for future trail development of Lake Jones area. <br />7. The subject lot contains the following non-conformities: <br />a. Required covered parking deficiency (22 garage stalls); <br />b. Curb and gutter are missing for most of the parking and driving area; and, <br />c. The landscaping is missing to screen the existing off-street parking areas <br /> <br />BE IT FURTHER RESOLVED, that based upon the above fmdings of fact, the application FP <br />05-05is hereby approved with the following condition: <br /> <br />1. A trail easement is provided to connect Old Highway 8 and Jones Lake and an <br />easement agreement is approved by the City Park and Recreation Director, the City <br />Planner, and the City Attorney. <br />2. Assurances in the form of a letter of credit in the amount of $175,000.00 <br />is provided to the City by the applicant that the following non-conformities on site <br />are corrected by December 31,2005, in accordance with <br />NC 05-02 and LP 05-02. <br />a. Twenty-two (22) covered garages are constructed on the site; <br />b. Curb and gutter are constructed around the entire parking and driving area; <br />and, <br />c.
